Buying handgun from private individual

Busby I would just go through an FFL which can do the background check for you.

Do not get confused about what an FFL can do. There is no national database of stolen guns that an FFL can access. The FBI NCIC is for official law enforcement use only, an officer using it to help a buddy find out if a gun is stolen is likely to get his NCIC access revoked.

FFL's use the FBI NICS to conduct the required Brady Check on firearm purchasers. The NICS check is on PERSONS, not property.
 
In my county a simple call to the Sheriffs office and they will run the serial number.You can always call them and ask if they do it for citizens--that's what I did,and the sheriff said YES,call anytime.
 
I usually live by 3 good rules when it comes to buying selling firearms.
1)Always buy from friends when possible,or take a good friend with you to the sale.
2)Know as much about what you are buying before you get to the sale.
3)If you feel that you may not be be getting the right deal or best deal or that the seller is shady in any way,agree to meet them inside a gun shop for a official transfer.

Number 3 rule happend to me last week,a guy i didn't know was suposed to buy my S&W 66-2 for 500.00,but instead showed up with a new glock.Now i was mad about not getting the money in hand but after the shop owner confirmed that it was indeed a new gun and i was sure he wasn't trying to rip me off i took the deal and am happy with the way it ended.He got an old revolver and i got a new gun and a fun experience shooting a new caliber that i hated but now love.:D

Btw the price on your sellers sig isn't that great,you can buy a used sig from www.summitgunbroker.com for 525.00 and even a nickel 220 sig for 595.00 and buy the extra mags your self and still come out with almost 200.00 or more for ammo.

I keep some generic bill of sales that contains name, drivers license #. name.model, and serial # of gun. If they don't want to do it I don't buy. Its a private record thats kept my safe thats not required in tn. Tenn is non register state. What if you meet the guy a mcdees and buy it with no paperwork as soon as you leave he calls LEO idenifys your car and claims he saw you steals it out his car. you could have a problem. BTW our local police dept will run serial # I had them run several last year for weapons that I had acquired before I statred doing this.

As long as you don't believe the buyer is ineligible to own a gun.

Short answer--ask him if he has a CHL/CCW/call-it-what-you-will. If the answer is "yes", he has already passed a far better background check than the FFL process affords.

I've saved the pdf and made a couple of printed copies to take with me to gunshows.
 
I live in Georgia, where it's perfectly legal to buy and sell guns between private individuals. But, I had an interesting run-in with an ATF agent regarding a transaction I made with an individual last year. I listed a handgun on a classified site for gun traders here in my state. I sold it to an individual who presented me with his state issued carry license, he gave me cash and we were done. He then proceeded to put the same gun up for sale on another website at a higher price than what he gave me (perfectly fine with me, after-all it's now his gun). Well a few weeks later ATF knocks on my door to ask me questions about the transaction. They got the serial number from one of the pictures he posted on the other site and traced the gun back to me through the original dealer that I bought it from. Everything I did was perfectly legal. The problem the ATF had, was with the other guy. They had been watching him for a while, because he had been buying and selling guns like crazy without a Federal Firearms License.
