Brand new gun doesn't function, can it be returned ?

The idea of a loaner gun is a real bad idea. Most gun stores won't give out loaners

That was a joke, the absurdity of such an idea is where the humor comes from(supposed to anyway). I had NO expectation of such a thing happening.

Hang in there !!!

There is no law preventing them from taking a gun back,,,

Bingo and as stated before, I even returned "used" guns to "some" LGS and dealers. .....

LGS represents itself as "high end", and couldn't even come up with a box. Not sure if it's worth a letter to the owner. Left a voice mail for manager asking for help obtaining a box, and he hasn't bothered to call back in 24 hrs.

Well, there's a red-flag and if you dig deep enough, I feel you will come up with more. . ;)

Because in some areas that is the ONLY choice you have.
SERIOUSLY ???

Be Safe !!!

Why would they want to keep - what is trash to them - hanging around their store?
What do you mean by "high-end"? To some that is $500; to others it is $5,000; and to others still, it is $50,000 and up.

WHY DID YOU NOT NAME THE GUN ??

Mfr is only party involved right now that a) Has acknowledged this shouldn't have happenned, and apologized. b) Has immediately sent me a shipping label and c) Is about to receive my gun and hopefully go over it with great care to make damn sure I don't have problems again. I see no reason to throw them under the bus.

WHY would you do business with a gunstore like yours ?

This is the first ( and clearly ) Last time I spend a friggin cent with them. If I knew then what I know now, I wouldn't have.

That box has the serial # of the firearm shipped in it. Also cause -CENSORED--CENSORED--CENSORED--CENSORED- happens, If I owned a gun shop, I think I could break down 1 rifle and 1 pistol box and put them behind a door, under a workbench, etc... for just such an occurrance. Actually , for collectors, having an original box w/ serial # on it is a big plus and adds significant value.

Agreed sir. What I mean when I say the store represents themselves as high end is:
Indoor Range w/ programmable targets that allows calibers up to 50bmg
Cafe
Tactical Clothing
Training on site
Competitive matches
AR-15's to $3500
AR-10's to $4000
Custom/Semi Custom pistols to $6000

The gentleman at the gun shop that hand lapped my scope rings before mounting glass, is former scout sniper, and then taught sniper school. Yes I believe it, he has all the certificates that seem to back that up. He has been the only positive thing about the place.

Are you talking the original packing box or the outer shipping box? The maker's box should have gone home with you. The plain cardboard shipping box is what I was talking about - there NO info on that shipping container.

Since I am not in the business of shipping long guns, I was referring to any box I could have used to return gun to Mfr in. I received no box when I bought, makers or shipping. I probably would not have wanted to ship in makers box, as it's kind of an ad for what's inside.

The last new rifle I bought came in a box from the LGS, I kept the box and just recently had to ship said rifle to Boyds to have a stock made, shipped it ups in the original box that had the name of the gun on the outside of the box, went there and back to me, no problem, ups ships guns daily.

I used to work for Bass Pro, they would accept a firearm on return if it was unfired and was returned within 30 days of purchase. If the gun has been fired it is now a used gun and cannot be sold as a new one. I understand some stores will not accept returns for any reason. They do come with a warranty from the mfg who screwed it up in the first place.

As does Fedex, but I haven't seen any shipped in the maker's box only; that box is usually placed inside a plain brown cardboard box.

Did I miss the gun? What is it? We might be able to help, provide insight into known issues, fixes etc. is my reading not fundamental here?:D

Lots of guns have quirks or known bad batches etc. If we know what we are looking at we might be able to help / speed things along.

I don't see where the LGS has done anything wrong. Until the OP tells us more info It's hard to say. Could be most anything including trying to chamber the wrong ammo.

Yeah gun store sounds normal.

Doubt dude is feeding wrong ammo. I am thinking out of spec heat treating/chipped extractor, maybe bad chamber cut, gunked up gas tube????? My early SIG 556 had so much of that coppertone smelling preservative on the gas piston and chamber I doubt it would have functioned etc. this was fairly common on the early ones.

Point is there are lots of us who may know about common issues, bad runs, weird preservative overuse etc. cannot help without knowing more.

Without naming the gun in question this thread is a bunch of hooey. And stuff happens to all manufacturers, so telling us what brand and model of weapon isn't any big deal.

And yet, many here would have ripped the OP for identifying the manufacturer without giving them a chance to fix it before complaining on a public forum. The question had to do with returns to the LGS. Brand of rifle is mostly irrelevant to that question.

Don't disagree but like when bringing a car to a dealer it's always nice to say look at this tsb or this is likely what needs to be fixed vs getting back the old operating within specs brush off.

New or "New"

The first two paragraphs could be misleading. Was the rifle purchased from the LGS or bought somewhere else and transferred through the LGS?
Did the rifle come with any paperwork? Sometimes display boxes go missing or get mixed up, but I'd be a little suspicious of a rifle being sold as "new" that did not come with a gun box or manufacturer's paperwork. Did you get a discount?
Whenever I need to ship a rifle, I just grab a shipping carton out of the LGS's dumpster. It's usually overflowing with cardboard.

Buy your next gun from Gallery of guns and have them ship it to the same gun shop, at least you know when you use Davidsons that they have a lifetime guarantee on the gun. I bought a shotgun one time from them and had to bring it back within a week-They mailed the gun shop a new gun for me no questions asked!!Not always the cheapest online gun dealer but they stand behind every gun they sell..

Thanks

Thanks gents.

KyJim has got it.

I'm not here to bash the Manufacturer. They seem the only ones interested in making this right for me.

My post had to do with a rifle being non-functional right out of the box.
And the LGS not even returning a phone call to me when I asked for help finding a shipping box.

I've had guns develop issues, and Mfr's fix them. Stuff happens.

What would you do if you bought a lawnmower that wouldn't start the first time you tried to use it ?

Or a Big screen TV ?

They both probably come with warranties. But you just spent a large (to you) amount of hard earned cash (Maybe more than you should have). And while there is a warranty in place, I guessing most folks would answer:

I'd take it back to where I bought it.

Now with that said, I understand firearms are a different animal. I did not ask LGS to take it back. I did ask them for help finding a box.

Guess that was too much to ask.

I had never actually thought about whether or not you could return a gun. I would guess you can't but at the same time I have. I purchased a lever action, took it home and realized that the sights looked crooked. Went back and asked the dealer what he thought. He looked, said the same thing and asked if I wanted to swap it with a different one. I said sure, he looked at the others and told me they all looked bad. He asked if I wanted in store credit and I bought a different gun the same day. Good guy I suppose.

Aren't they all fired at the factory? This guy didn't actually get it to cycle right? Well keep us posted.
Here is my nice $.02 LGS story. I bought a SR22. It was just sketchy. Mag had to be popped in firm to set. FTF,FTE, just no fun. Did have a 80% ish fire rate, the rest trouble. Told LGS. He offered to send it in. I was ok with it, but I sent it in myself. Ruger service was great. They machined and replaced some parts and got it back quickly.
I still didn't like it. Just not smooth. LGS had another, two tone and he offered to swap them for $50. He knew it had been serviced- I told him. The new one seemed much better to me. And was like $25 more anyway because of the finish.
I didnt expect a free swap. Not fair to him, but he tried to help, and in the end I paid a little and got square on the deal. Maybe your LGS can do something similar.
