It could very easily be a local (city / county) definition.wogpotter said:"Destructive Device" is a very specific type of "industrial strength" firearm which no air gun is even close to.
We have special definitions all over the country.
For example, North Carolina classifies machine guns, 'assault rifles', and 'silencers' as, "Weapons of Mass Death and Destruction."
And, there are some parts of the country where a state, county, or city classifies or regulates pellet rifles as "firearms".

I have an Umarex Beretta 90-Two air soft pistol that I use for shooting annoying dogs and cats (primarily my own). It was $16 when I bought it about six years ago, is manually operated (spring), and definitely falls into the 'cheap' category. But... It has decent heft, I've put over 6,000 pellets through it (probably 4,000 of them for one dog that loved rolling in cat crap ), it's still good for about 300 fps, and it'll maintain minute-of-cat groups from my patio door to my back fence ... about 15-17 yards.
It does take some practice, though. That barrel puts back-spin on the 6mm BBs, so they rise about 2 feet from the bore axis, in that distance.
It'll never be an ideal tool for trying to tighten up groups, but it's a great tool for a little bit of legal trigger time in the backyard or basement. And, sometimes, I even take it to the range when I'm working with rifles. It's nice to kill time with, while waiting for barrels to cool between strings.
