Bad CCW Situation.

According to OpenCarry.org with regard to Iowa

http://www.opencarry.org/ia.html

Iowa is not a traditional open carry state, but no permit is required to open carry except when in vehicles or when inside city limits. Open carry in cities is technically legal with an Iowa permit to carry weapons, however Iowa is a may-issue state, and some sheriffs have indicated that they will revoke your permit for open carrying.

T.A. Sharps,

Show us the Iowa statutes that back your statements up. In the country of America, and in the State of Iowa, statutes are written to make actions illegal. Show us the statutes that make open carry in Iowa, with a license, illegal.

You are from Iowa. You've taken the class. You claim to have more knowledge than me, so PROVE me wrong, post the statute.

Also, please do us a favor and go here:

and tell these fine folks that their actions are illegal and see what they have to say.

Open Carry:
Prohibited unless one possesses an Iowa permit to carry.

T.A.Sharps,
You were simply misinformed by the CCW instructors. They either had false information because whomever trained them gave it to them wrong, or they put out misleading information because they do not favor open carry. It's messed up that a CCW permit can be revoked for any reason, but that does make open carry illegal. Obviously, it might be a good idea to get into the statutes yourself and see what the statutes really say. If your CCW instructors were wrong on this issue, they might be wrong on other issues as well.

Thanks for all the replies everyone, I always like it when I finally post something that it turns into a big conversation like this.

First off...
(other than NavyLT's comments)

I do hold a permit for CCW.

Aslo, this was a completely HYPOTHETICAL situation.

I was fully aware of the time of night and I saw nothing wrong with the store clerks' actions.

Furthermore, I left my weapon at home simply because I was in a hurry to get out the door and had forgot to grab it, and I was busy enough not to want to drive all the way back home to get it.

The only thing I was uncertain of is the legality of me telling the clerk that I had a permit to carry a concealed weapon, and I had my weapon on, and could not show it by lifting my coat, if he had asked me too.

I know I can't show my weapon at all. I am not 100% sure, as far as wanting to gamble in court, in saying that I have a gun and a ccw permit would not be considered legally exposed in a court.

I wouldn't be worried about being arrested, or illegally searched. I would be worried about having to wait around for a cop to show up, and then go through the whole spiel with him, and have him talk to the clerk, and then give me the ok to leave. As the cop would of been the only person I knew for sure I could tell legally that I was carrying a concealed weapon.

I also would not of wanted to the clerks to call the police about this shoplifter that left the store, then the cop finds me, and my weapon, driving around later.

I feel that staying there to speak to the cop then would be the best option to avoid any entanglements later.

Going back to the original scenario...

... I'd have told the clerks I was meeting my girlfriend, but that she seemed to be running late.

I'd also have bought something, using a credit card. Who in their right mind robs a place that has their electronic info on file for the time of the robbery?

The same technique works pretty well for getting around "Rest rooms for customers only" at stores and restaurants during peak season - buy something. It's amazing how much flack that will alleviate.

After all, they are running businesses, and aren't there for you to just hang out.

Navy guy, just cause there is a law on the books says it is legal, there are others they can use like disturbing the peace. I live here, never ever see anyone open carry cept in the gun shops. Use common sense here, Iowa loves to imprison folks for long periods of time for making silly mistakes.

Folks see a guy carry they call the law, you get questioned and advised to not open carry. I have talked to my friends in the sheriffs dept about this, they do not recommend it at all and will challenge anyone who is doing so.

In CCW class, they say CCW means CCW, they do not ever say well you can open carry all you want now. The Sheriffs dept trains you here for CCW not some guy from a gun shop.

There is a law about loaded weapons too, look it up, an empty gun is what? same as a rock. Also discharge of a firearm within city limits will get you some trouble.
