Of course, he could take it before the Supreme Court to receive a ruling on if it is Constitutional or not, but he still must enforce it until the SC rules that it is not a valid law. He was giving the legally correct answers to Ms. Swinestein; nobody knows what he would want to do in that situation, only what he was required to do.
