The standard response to a new firearm that fails to work properly is to send it back.
You paid good money for a good gun and didn't get it.
Make the manufacturer make it right on his dime, that's why they give some sort of warranty.
Most companies today will pay shipping back if you contact them so it shouldn't cost the owner.
