Stolen property is supposed to be returned to it's owner. If a gun was reported stolen by serial number/make, it should show up on an NCIC check.
It doesn't make one tinker's damn about politics or how the department feels about guns- your properly should be returned to you. If it isn't, usually having an attorney contact them will get results.
Knowingly keeping your recovered property could be considered possession of stolen property.
