How 'bout if everyone stays out of Brooksville, FL.? They apparently don't want anybody to spend money in their hellhole town anyway.

I live in a college town and it is right up the street. I had a ticket for a forgotten reason, but one of these little twitts took it off of the windshield. The only reason I know it was because I got a note in the mail from the City telling me of the "increased" fine for not paying it. I was fortunate as I was NOT the only person to complain about "missing tickets" so it was adjusted to the original cost.

Amazing that people can come up with excuses, half-baked though they are, for how this is a legitimate action of government.

Well Scott, tell ya what:

Lets say you get sued for $50 for a bad check. The victiom gets a judgement against you that you ignore. So he executes on your house. You have a problem with that?

Do you guys understand at all how civil law works?

How true, It is a shame to even be arguing government overstepping it;s bounds so far beyond where it should have ever gone in the first place.

We should all be crying the blues or screaming at the top of our lungs at the unprecedented controls and tyranny destroying our freedom.
Not arguing if taking a car over parking ticket is unjust.
Loook what is happening.

Civil? one owing a personal debt to another is different that failure to pay a fine imposed by a government entity. or am I all wet?

To make it a little more clear... It's a lien that is executed against personal property in order to satisfy the debt, and usually goes with an "either/or"... As in "Either satisfy the judgement+costs, or this property may be siezed/sold to complete judgement satisfaction"--NOT the person simply taking your house to satisfy the $50 bad check. Normally it doesn't go against property though, but rather takes the form of wage garnishment or an account levy through a civil processor.

Personally, the idea of the city escalating this over a $5 parking ticket is beyond extreme, but then not much seems to make a whole lot of sense to me anymore. The more absurd it seems, the more plausible it becomes.

From the OP

Florida: City to Seize Homes Over a $5 Parking Ticket
Brooksville, Florida proposes to foreclose homes and seize cars over less than $20 in parking tickets.

What about in a instance such as I spoke of earlier. I received at ticket in another's car. If this is true then under just the right circumstances a person could lose their home unknowingly, if away and not informed for one reason or another.

How true

Why would anyone willingly live in such a place?

In the post where i got the ticket in dads car. I was in another city 25 miles From where he lived. One could easily get such a ticket as a visitor and have no idea the consequences if not paid.

Not having read the statute I cant comment on the procedure in the instant issue, but here is how it works, contstitution wise:

1. You get ticket.
2. You ignore ticket
3. You get notice.
4. You ignore notice.
5. You get judgement against you.
6. You get notice of execution
7. You fight or pay or whatever or
8. You property gets sold either real or personal, subject to laws surrounding exection on judgements.

Here is alaska, they just hit your permanent fund

Communism at it's finest

That's a part of the communist manifesto! The state seizes all private property through excessive laws. That's unnecessarily putting good LEO's at risk. Since the car and the house is govt property through taxation, they will try. Keep those receipts. What if they ticket you just for the heck of it? Solution? Get out of the cities. Does that violate the fourth Amendment?

Easy in today world to be driving a $60,000 car. Seems excessive to me, when the next guy may be in a $600 wreck on wheels. Can we say fairness?
Sounds fair to me, their both not driving any more.

It's good when your type does this. Publicly displays ignorance, that is.

I've been in business for a LONG time. I've collected on a LOT of bounced checks...for a lot more than $50. If it's a $2000 check and thus a felony you STILL won't be taking his house. You might get a lien on it, but you'll never collect it until the person refinances or sells...and often not even then. You'll need a conviction to even get a body attachment and even then it's hit and miss.

But hey, when I go over to the courthouse next week to file the latest batch of checks with my wife(who manages a couple large groceries) we'll tell them that you said we should take people's homes over these checks and see what they tell us, ok? Maybe you'll be able to hear the laughter without help from the in-tra-web.

As such, you rather made the point. In responsible government you, neither as an individual or a government entity(or a corporation) get to steal from people using miniscule debts as an excuse.

THAT is how civil law works(when it is working right).

So much for intelligent conversation.

Gentlemen, and any ladies present, this thread is closed. Between the animosity and personal attacks, can't get a word in edgewise....
