Sure, anything can be an issue under the proper (improper?) circumstances.

Perhaps it would have been more accurate to say that it's no more likely that a person would be taken to task for shooting "too many times" (as long as the shooting was justified) than it is that they would be accused of using "too big a caliber".
 
Don't count on TX being definitionally 'sane' - it will depend on the jury. You can certainly find antigun folks here and if on your jury - that could influence them.
 
I'm a fan of .22mag ... always have an NAA Pug with 45gr Hornady Critical Defense rounds in my pocket when I'm home .. also have a new LCR in that cartridge, awaiting a holster I ordered and will probably be carrying it in place of the Pug on dog walks and around my little town ... If I'm heading out of this burg, I take my PM9 ...

My wife hasn't shot either of them; when she comes to the range with me, she takes over my Smith 22a and she's very good with it. Does NOT like recoil ... I think she'll like the LCR ... make a good nightstand gun for her .. I'll keep the 1911 ...
