Another "the gun went off" defense. Note the third paragraph.

10-year-old boy critically injured in accidental shooting

DALE CITY, Va. (AP) - A 10-year-old Dale City boy suffered critical injuries Thursday when his teen-age brother accidentally shot him in the face.

The boys retrieved a revolver from under their parents' bed after the parents left the home for doctors' appointments, Prince William County Police spokesman Dennis Mangan said.

The gun had a combination trigger lock and was not loaded, but the boys either knew the combination or the lock was already placed on the correct setting, Mangan said.

The 13-year-old brother loaded and unloaded the gun, then realized he left one bullet in by mistake. As he tried to remove the last bullet, the gun accidentally went off and the the 10-year-old boy was shot in the face, Mangan said.

He was listed in critical condition at Children's Hospital in Washington early Friday.

The boys have not been identified. Mangan said it was unlikely the parents would face criminal charges.

Correct me if I am misinformed, but there has never been an AD involving a child who completed the Eddie Eagle Program.

Millions(?) of kids and counting.

Assuming the article is correct in all particulars:

The parents, with the false sense of security provided by the lock, left the gun where it was accessible by their kids;

The parents negligently failed to teach their kids how to clear a gun (unable to get the last round out of a revolver?);

The parents failed to give the basic safety message of Eddie Eagle to their kids.

As hard and callous as this may sound, the parents asked for this to happen. Too bad the kid was the one who paid the price for their negligence.

It is a shame. I posted the links to the Wash. Post stories on this the other day in Legal. The kids wanted to play cops and robbers, or whatever, and when one of them couldn't get the last cartridge out he cocked the hammer to get a better look at it. The other one was running back and forth and happened to be in front when it went off. No one is being charged. The youngster died. John

So what's the point? Kids drown in buckets of water, bathtubs, get lighters, matches and burn down the house around themselves, poison themselves with household chemicals, kill themselves in car wrecks, cripple themselves in sports accidents every day. An accident is just that, an accident.
