Okay, my spanish is bad. This has come up before but now, it's in my court. To LongShot, Eugene doesn't seem to have any city ordinence agaist open carry. Okay, to all: You have called the LEO's in and around your county.... Open carry is okay but no one does it due to "afraid" of the cops being called. You are legal, CHL is almost impossible if you can't prove six months residence... what do you do? DO IT (and as a local gun shop says," you can do it but do you have the cajunan's to do it?" or just "go with the flow". Longshot, give me a heads up here, you live here (in the area). Thanks.

As long as it's legal, I'd do it. Carry a copy of the ordinance. I did this here with regard to carrying in the car when I found out that though most cops thought the ammo had to be kept out of reach of the gun, that's not so according to the law. It's a chance, sure, but what are the odds you'll run into a cop so stupid he can't read the law?

Also, I gather Missouri is kind of this way, and I plan to carry open when I'm there in a couple of months. Since Illinois doesn't have these gray areas I'm going to practice my rights when I get the chance.

PS--Be VERY polite and think retention.

Sadly, Arizona, a proudly open carry state seems to be going the same way. I was in Lake Havasu City last week and carried open the entire time. A mere four years ago, this created no hubbub. No longer.

A manager at Safeway attempted to ask me to leave until I engaged. He turned out to be a real good guy but explained that their business was dependent on the CaliCrowd who often freak out at the sign of a firearm. We ended up in a conversation about whether he should buy a Glock 26 or 29.

A lady at Queens Bay condo's approached two friends who live there and told them that I had "frightened the children to death" with the weapon on my hip. As good RKBA types, they explained AZ law and the fact that I had come out for a shooting course and seldom went unarmed. The punchline was when Ms. Lib explained that her husband probably would have thought it was "cool".

Lake Havasu needs better role models. I'm putting a bid on a condo today! ;)

Don, I wouldn't in Missouri if I were you... You're likely to get a Glock screwed into your ear... Sure, you can carry openly, but they tend to arrest you, and charge you with disturbing the peace or brandishing a firearm, etc...

Don Gwinn, you said, "...what's the chance you'll run into a cop so stupid he can't read the law..."

I can assure you, today, there are lots of cops out there, who, due to years of affirmative action hiring and qualifying practices, are too stupid to read and COMPREHEND the law.

FWIW. J.B.

I just thought of something that Bogie said. I didn't even ask about the brandishing a firearm ordinance, if they have one or not. I'd forgotten that one thing may be legal but then you run into some other thing that makes it illegal. Thanks for that one, I have to make another call to verify. Also, Don G brought up a good point, to carry a copy of the law with me. But then again, all I should have to carry with me to carry anywhere is a copy of the BoR's but I doubt that would get me out of the ticket/arrest. Thanks again all.

Maybe I should rephrase. When I say I do it, that means I do it. It does NOT mean it's necessarily a good idea for anyone else. I've thought about whether I'm willing to take the chance that I get arrested even if it's a clear violation of the law and my rights. While a student (broke and dependent on my parents) I didn't feel it was right to take that risk because, knowing my parents would help out, I was playing with other people's time and money.
Now I'm on my own, have my own job and home, and I've decided that now is the time to start making small stands as the opportunities arise. I agree with Glenn that anyone who is going to take this kind of chance should think it through and try to think of the ways someone could screw you, 'cause somebody will try it. But I think it's essential that somebody do this sort of thing, and I recognize that not everyone is in a position to do so. Fine. But I used the excuse that I wasn't in a position to do it long enough. Now I am, so I want to do my part.

All that doesn't mean that I'm trying to provoke some showdown with the police. I respect the cops, but I also know something of how hard it is to be one and I know not all of them keep up with politics or new laws. I also know that some have deceptive superiors who are actually willing to lie to their officers--like the former head of the Illinois State Police, Terry Gainer. And I believe that most cops will give me a chance to explain politely that I don't believe what I'm doing to be against the law, and that most cops will at least take a moment to read the law (in IL, I use a Q&A article written by one of the new heads of the State Police--it has a more official feel to it and is more convincing than some copies of the bare statute I've used.)
Therefore the risk is that I run into the rare cop who's so bullish he won't let me speak or read a copy of the pertinent law. I accept the chance that I'll run into that individual as the cost of the way I choose to live to the limit of the law. Again, that does not mean that you will or should choose the same thing.

Well, I'm a member at St. Louis Benchrest Club, and a little while back a bud and I were shooting on the main range, while a buncha cops were on the handgun range (which is further down the access road). These weren't city cops, but were largely reserve cops from rural areas... A BUNCH of 'em, generally the younger ones, gave us the serious hairy eyeball treatment, occasionally with the slowdown, then stomp gas/testosterone, as they drove past. We weren't shooting "evil" rifles, just varmint and BR rifles... But from the looks we got from some of the younger ones, they couldn't wait to do some stompin'... I've got long hair, and my bud (the M.D.) and I were likely both wearing tie-dyes, for what that's worth, and my truck is a mix of camo paint and grateful dead and NRA-type stickers...
