You carrying your friends guns in states where they do not have reciprocity

Okay,

Say I am from Texas and I have a friend from Louisiana. Both of us are CHL holders in our states. Both these two states have reciprocity.
BUT, say we get together and drive into Arkansas. Arkansas has reciprocity with Texas BUT NOT with Louisiana.

If we were in my car would it be legal for him to take his gun off his belt and put it inside the console or glove compartment in MY car. That makes ME concealing and carrying that particular gun.

If we were in his car would it be legal for him to pass his gun to me and let me put it in my belt while in arkansas? That way I am concealing and carrying that particular gun.

Does he get in trouble in any of these circumstances?
 
Why would he? None of the laws say that the gun has to be registered in your name to carry it. If it was in the glove box of your car, and you got stopped, why would you say "it's his gun." If you're not doing something wrong, they aren't going to run a check on the gun.

I think you would be fine. But then I am not a lawyer either, so YMMV.
 
It depends on who has immediate possession of the firearm. If it's on him then he has possession of the firearm, if it's in your property (the car) then it's in your possession.

But you have to check each states law. If the firearm is within the reach of a non-authorized person (your friend and where he can get to it) then you may be breaking the law. It's not a clear cut black or white situation so therefore cannot be truly answered by those of us that aren't familiar with that states law.

P.S. what is it that ya'll are doing to get the LEO to have PC to pull you out of the vehicle and do a search :confused: . Most stops are for traffic violations and as long as your papers are in order, you get a ticket and on your way.

i think you'd be fine unless it's on his belt.

but yea to wayne. i've been stopped in illinois, worst state in the union, cases in plain sight (on my way hunting) and the officer busting me for 34 in a 25 at 2am didn't even mention it. i don't think you need to worry too much.
 
Don't know the law in Arkansas, but I do know that many states will allow carrying a gun (even concealed and/or on your person) within a vehicle, even if you don't have a CHL for that particular state or a CHL with reciprocity with that particular state. Many states consider a vehicle like an extension of your home(since it is your property), so you can legally carry within a vehicle. Just make sure you don't exit the vehicle to get gas, go into a convenience store, etc. with your pistol. Besides, if you are abiding by the law and not driving like you're at Talladega, you won't have any problems with the police anyway:rolleyes: .

Nothing. This is just a hypothetical situation. I don't know anyone in any other state that has a chl...in fact I only have one friend out of them all that has a CHL besides myself...and he just got his about a month ago. But if down the road something like this should ever come up and I was stopped and the police for whatever reason needed to search the car are need to talk to everyone in the car, just wanted to be within the law. Don't want the local DA to have any excuse to persecute me or anyone I know.

The best thing to do is to contact www.packing.org and find out which state offers a non-resident to will allow for Arkansas, which would be Florida. Have your friend get the Florida permit to cover the states that you and he may wish to enter.

I know that asking permission is something that really knaws at us but for the time being, and to keep out of jail, that is what must be done to travel and have our means of protection also.

Doug, that is why you need to goto the www.packing.org and look up the various states.

Florida, being the one state that started this, opened up their permit to anyone, everyone that is legal to have a permit.

That is why we are here Doug, to help :). Go for the Florida permit, they are expensive but well worth it, trust me.

www.packing.org is indeed an excellent website site for laws on carrying. I think though that with the passing of Interstate Commerce act you are fairly safe going to states where it is legal for you to own a firearm from states where it is legal for you to own them, as long as they are not readily acessible. Florida terms it "peaceable journey" I think.
