I got my Steyr M40 back from GSI after about 2 1/2 weeks. I am very pleased
with their service. The implied Steyr warranty paid for the one-day UPS and
I had a balance of $0.
For those that are interested, the top of my slide was getting dinged up
quite badly from ejected brass. Brass ejection could be anywhere from over
my right shoulder to almost straight out in front of me as well. Once in
awhile, I'd pick one up right on the forehead.
I'm happy to report that after firing 150 rounds through my upgraded M40, it
no longer dings up my slide. It still has a wider angle of brass
ejection than some guns I've shot, but I can live with that. They also
re-blackened my dinged up slide area. So that's 1,150 rounds I've put through the m40 so far, in addition to the test firing at GSI --- not bad for the first month
What does the fix look like:
The top front of the ejection port edge used to have a 90 degree angle;
It has been tapered to roughly 45 degrees to allow the brass to get away
cleanly. Also, the top back right side of the ejector port has been rounded to
roughly 45 degrees, so it is no longer a 90 degree corner.
Bottom line: it's a keeper
So, serial number aside, you should be able to tell if you are looking
at an upgraded M40 or not at the gun store. And remember, a lot of the earlier models don't have the extreme problem my m40 had, for whatever reason. But I wouldn't make a big issue out of it. If your M40 does have the "dingy" problem, you can have it repaired within a couple weeks, and then you have one of the hottest pistols on the planet.

the 9mm case is a bit narrower and is therefore ejected cleanly.....
