YES: SCOTUS COMES THRU

One down, one to go. Any bets that ALGORE will concede after he has lost these two??? I'm taking bets the he still 'fights on' (in his nomenclature)!!

Once again, CNN is right on top of things. Just like when they declared that Florida would go to Gore on election night.

This from CNN:
No U.S. Supreme Court ruling today in ballot recount
December 4, 2000 Web posted at: 11:27 a.m. EST

A ruling from the U.S. Supreme Court on the ballot recount issue will not come until Tuesday at the earliest.

HA! Bite me, Al; and bite me, CNN!

The decision by the SCOTUS was UNANIMOUS! Bush's lead goes back up to 930.

Rush is claiming that it has been remanded back to the FLSC and they must explain on what basis they made the ruling and thus it could get kicked back to the USSC.

From what I understand the US Supreme Court vacated the Florida Court ruling and sent
it back the the Florida Court to explain why and how the came about their ruling then the
Florida Court can send it back to the US Supreme Court for further review. So the ruling
wasn't really overturned, but the time factor is on Bush's side for the states to have all
the electoral votes by 12DEC.

Walang-
You're right. They actually "vacated" the Order. This indicates that they are telling Florida that the order is improper, but would reconsider subject to further information. In any case, it's a Gore loss, regardless of the, "Oh, they are just asking for a bit more info" spin.

Listenting to CNN via the 'net right now. Press conference from the democRAT Boies. To hear him spin it, you would think that they won this case. What a moron!

The media reports I'm hearing cast the result as completely neutral. I don't see how it can be neutral in its effect. To me, it clearly seems better for Bush, whether or not the Court intended it to be. Just more biased media coverage, as near as I can tell.

The Supremes took the easy way out. Rather than saying the Florida Suckpremes got it wrong, they said they couldn't determine the basis for the ruling. Now, the Suckpremes have to come up with a good basis . . . something other than wanting Gore to appoint them to the federal bench.

"...Specifically, we are unclear as to the extent to which to which the Florida Supreme Court saw the Florida Constitution as circumscribing the legislature's authority under Art. II, Sec1, cl. 2. We are also unclear as to the consideration the Florida Supreme Court accorded to 3 U.S.C. Sec.5. The judgement of the Supreme Court of Florida is therefore vacated (read overturned), and the case is remanded (read "shoved back down your throat") for furthur proceedings not consistent with this opinion. It is so ordered..."

Buzz, I don't agree they took the easy way out. This is brilliant! They cite "circumscribing" the legislature and request the FLA Supreme Court to clarify how they read the US Constitution and the US Code 3 Sec 5. This is a home run regardless of what the media talking heads say, the FLA Supreme Court must either accept the Vacation of their original order or come up with a legal, not Florida State Constitutional, reason WHY they can support the decision. They can't, the law is clear and they can't change it.

Now, where's that fat lady????

I agree with AmericanFreeBird..

The SCOTUS is saying essentially to the FLA. SC they better have some way of getting around the US Constitution and US Code, other than quoting 'Equitable Powers'. They don't have a way unless of course they want to make larger spectacle of themselves than they already have.

9-0. That's a nice scoreline, time for the FLA. SC to take its spanking from the SCOTUS and go straight to bed!

4:30 ET for Judge Sauls action - just out.

What's with Judge Clarke's case? Sounds like they have some snafu on where people are - not clear to me - just tuned in.

AmFreeBird: She's still trying to clear the hairballs.

I think SCOTUS is giving the FL SC an opportunity to save face. If the FL SC comes back with another opinion like the last one, then they will go down in flames.

"The judgement of the Supreme Court of Florida is therefore vacated (read overturned), and the case is remanded (read "shoved back down your throat") for furthur proceedings not INconsistent with this opinion."

OK... not inconsistent (Please note I corrected consistent to inconsistent as per the opinion). Now you have to read their opinion to find out what they are saying is the law that the FL SC has to follow, when they re-issue their opinion. If you read this you will find that the SC says that they did not have the power to overturn the state legislature.. ie that the deadline must stand. This opinion is a strong slap on the wrist without comming right out and accusing the state SC of ignoring the law and rulling based upon political lines. Which if you have read the election law, was what they did.
