will they take my backup away?

I'm wondering: If I should get into a situation where I need to use my weapon, I understand that it will have to be taken away from me until everything is cleared up legally. If I should be carrying a backup piece, will that also be confiscated?

I'd guess so, if they know about it. The cops would not be able to immediately identify the bullet at the other end of the hole in the guy's chest; would not have a conclusive answer as to whether the shooting was justified (i.e., are you a criminal); and would probably take it anyway on general principles.

Since it will treated as a crime scene, all firearms at the scene will be taken for testing, or should be taken. Get a receipt for yours. Expect to take a trip "down town" too. Say nothing without your lawyer in attendance.

4 years ago I pulled a handgun on a couple of bumbling idiots who picked the wrong day to B&E my posted rural property. Them not realizing the reason the gate was open, was because I was there. I didn't draw until one of them got confrontational. 2 of them, 1 of me. We argued (less than intelligent content) they left, no shots fired. 911 call gets them arrested on road less than a mile away.
Sherrifs Deputy came back, read me my rights and confiscated. Since there were 2 handguns laying on the floor of my truck, he asked me which one I used. He took that one, left the other! Never understood that.
BTW, he returned it to me at my home the next night with an apology. His Lt. had called me that day and told me when the Dep would be returning my property.
