Why can't I conceal carry wherever I want

Hey everyone. Tried to think of a title that would get people's attention...not in a bad way, but just curious enough to read this and maybe give me a definitive answer. I realize that folks on this forum are from all over the country, and laws vary considerably. Here's what I want to know...Once you have your concealed carry how can an establishment override your right to carry anywhere you want. I understand that there are certain "exceptions", and even those annoy the hell out of me. We pay, what I consider to be a very high price, $112, for a carry permit here in Florida. Just so we can carry a gun, which is a constitutional right to begin with!!! No one in America should ever be scrutinized, interrogated, or made to prove who they are just to own and carry a gun!! It is offensive and unacceptable!! And the bottom line is, the governing agencies, be it states or governments, don't give a crap about anything but the almighty dollar bill!!! The same holds true for buying a gun and having to wait 3, 5, 7, or 10 days, or whatever ridiculous time frame is put upon us, depending where we live. BUT, if you have your concealed carry permit, that you just paid an arm and a leg for, you can walk your happy ass right out of the store with your gun!! What the hell is the difference? You're the same guy, with or w/o a permit!!! Is there any state that does not require anything but the cost of purchase, to walk in and walk out with a firearm? 'Cause if there is, I've got to go there. And I'm sure it will be an Open Carry state as well, which is the only way to carry. Our laws are completely backwards. It should be against the law to ever carry concealed...open carry only!! That way everyone knows who has a gun. I know that Vermont is the most lenient state concerning gun laws. Perhaps if I wasn't so old, and still had to work, I would get the hell out of this backward state!!! Really didn't mean to get this long winded, but I had to vent. Thanks for listening. Sincerely, JASPERADO

The owner of a private property has the right to dictate who or what is allowed on/in his premises (subject, of course, to anti-discrimination laws). An owner can prohibit firearms for the same reason he/she can post a sign that says, "No shirt, no shoes = no service."

It's the business owners' property and they can control what others can do on their property. I have a first amendment right to speech and to religion but I can't go into other's place of business and preach without their permission.

Generally speaking, having the permit/license indicates that a background check as well as other requirements have been met. I could be wrong, but I don't believe that a license/permit negates the NICS call in every state. It does here in Texas, don't know about the rest of the country. Insofar as waiting periods, we don't have those here either (barring a "Delay" response on the aforementioned NICS call), so I can't speak to that.

Is there any state that does not require anything but the cost of purchase, to walk in and walk out with a firearm?

Only if the state in question allows "private sales/transfers." In Texas this is perfectly legal, as long as the seller has no reasonable reason to believe that the purchaser is prohibited from legally purchasing the firearm (resident of another state in the case of a handgun, felon, etc.)

If you are buying from an FFL, obviously you have to fill out a 4473 and submit to an instant background check, unless the permit/license issued by your state is accepted in lieu of the call.

It should be against the law to ever carry concealed...open carry only!!

You are entitled to your opinion, but I am going to respectfully disagree with you on this point. I kind of think if you can legally own the gun and are not doing anything otherwise illegal with it, it shouldn't matter if it's open or concealed. Not real big on limiting freedoms.

That being said, given the option I would likely continue to conceal unless it was over the top inconvenient to do so. Some folks have opined that openly carrying places one at a "tactical" disadvantage, whereas I would just be looking to avoid extra attention. But that's just me.

As it is, the open carry of a handgun is illegal where I live except for certain circumstances. Since I choose to follow the law, we're supposed to be the good guys here, when I carry I conceal. I've also managed to make it through 40 years on the planet without once being arrested and would like to maintain that record. Greybar Hotel doesn't sound like much fun.

Welcome to the forum, hope you enjoy it.

There are many people who believe that a person has nothing whatsoever that meets the strict definition of a right, that he only has the privileges that the government chooses to allow at their convenience and their discretion. Others of us believe in the concept of inherent rights. The laws of the country reflect such a division in point of view.

If you want to carry your gun openly, that's fine with me. It's not fine with me when you try to tell me how I should carry mine. After all, I have rights that go deeper than your opinion of my behavior, and the reverse is just as true.

I have been a Floridan since 1970. I don't know how long you have lived in Florida or you may even be a native. You should know if there is any place that people should be background checked, it's in Florida. Actually, I am very happy that in order to acquire a CCW, people indeed SHOULD be background checked so all of us are comfortable in the knowledge that some nut job or foreign terrorist cannot legally acquire a gun to wreak havoc on the population. Read the news and see how just a few have made it so difficult for us law abiding gun owners.

And I'm sure it will be an Open Carry state as well, which is the only way to carry. Our laws are completely backwards. It should be against the law to ever carry concealed...open carry only!!

Sound like you yearn for the old days of the Wild West. The last thing we need are cowboys going around scaring the heck out of people with open carry. Like it or not, we have to adjust to the times. While it is true that open carry is allowed in some States, I'm not sure it's the wisest way to carry.

You are apparently new to the Forum judging by your number of posts. Welcome and enjoy. Research the many Threads about concealed carry vs open carry. It will give you hours of education and enjoyment...a menu for both sides of the coin.

This issue has been discussed into the dirt at TFL. I suggest rather than another rehash, the OP use the search function to research the issue.

A new take might make a new thread but the OP doesn't really add much.

As far as carrying everywhere - I suggest open carrying a 1911 into the MRI when the machine is on. It's your right and the experience might give you one leg to stand and keep you on your toes (or not).

Closed.
