What happens if you buy a house next to an elementary schoool??

A guy I'm taking a class with and I were talking about rifles and calibers etc., and he asked me if I knew the law regarding "Safe School Zones" and the legality of possessing said rifles and one revolver if you lived right next to a public school. He's thinking about buying a house and he had heard something about a victim-creation.......er, I mean, gun free zones around schools.


I didn't really know the answer. Idaho doesn't have any such law, but I honestly don't know how the Federal legislation turned out. Was this struck down? I seem to recall certain aspects were altered and there was a challenge being mounted.

Anyone know what's up?
 
This is from US code, title 18, pertaining to firearms. I tried once to translate it into English and embarrassed myself. So, I'll just cut and paste:

* (2)
* (A) It shall be unlawful for any individual knowingly to possess a firearm that has moved in or that otherwise affects interstate or foreign commerce at a place that the individual knows, or has reasonable cause to believe, is a school zone.
* (B) Subparagraph (A) does not apply to the possession of a firearm -






* (i) on private property not part of school grounds;

* (ii) if the individual possessing the firearm is licensed to do
so by the State in which the school zone is located or a
political subdivision of the State, and the law of the State or
political subdivision requires that, before an individual obtains
such a license, the law enforcement authorities of the State or
political subdivision verify that the individual is qualified
under law to receive the license;

* (iii) that is -
* (I) not loaded; and
(II) in a locked container, or a locked firearms rack that is
on a motor vehicle;


* (iv) by an individual for use in a program approved by a school
in the school zone;

* (v) by an individual in accordance with a contract entered into
between a school in the school zone and the individual or an
employer of the individual;

* (vi) by a law enforcement officer acting in his or her official
capacity; or

* (vii) that is unloaded and is possessed by an individual while
traversing school premises for the purpose of gaining access to
public or private lands open to hunting, if the entry on school
premises is authorized by school authorities.

Before I immigrated to Wild Wonderful West b'God I lived in the peoples state of NJ, I lived within 1000 feet of 3 schools and every time I went target shooting (about 3 times a week) I would call the police dept. and insist they have a officer present every time I put my guns into my trunk.
After a few months it got to where the police dept. gave me a signed statement from the police chief authorizing me to move the guns from my house to my vehicle and visa-versa any time I damned well pleased..
Harassment does work!!
 
From the Florida Statutes:

790.115 Possessing or discharging weapons or firearms at a school-sponsored event or on school property prohibited; penalties; exceptions.--

(1) A person who exhibits any sword, sword cane, firearm, electric weapon or device, destructive device, or other weapon, including a razor blade, box cutter, or knife, except as authorized in support of school-sanctioned activities, in the presence of one or more persons in a rude, careless, angry, or threatening manner and not in lawful self-defense, at a school-sponsored event or on the grounds or facilities of any school, school bus, or school bus stop, or within 1,000 feet of the real property that comprises a public or private elementary school, middle school, or secondary school, during school hours or during the time of a sanctioned school activity, commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. This subsection does not apply to the exhibition of a firearm or weapon on private real property within 1,000 feet of a school by the owner of such property or by a person whose presence on such property has been authorized, licensed, or invited by the owner.

Emphasis is mine. In plain language, you may do what you like on your own property, regardless of its distance to a school. However, other parts of the statutes prohibit acts such as sitting on your roof and surveying the playground with your scoped .375 H&H Magnum rifle.

Gun Free Zones

Gent's,
in Tx, we can carry weapons onto school property, and on/in the parking lots..........
But, not INTO the school itself.........
Other places, are Federal, and County, City courts facilities, and any and all public, and private business's, that POST a sign of SPECIFIC size, color, and lettering.
In a PROMINENT and OPEN manner.
Otherwise we are free to carrry with a CCW.
Alas, any establishment that makes over 51% of their revenue by serving or selling alcohol, are also prohibited.
Theses are a partial list, and one should get the State law Handbook prior to carry.............caveat emptor
