Wallet holster

Hello, I am interested in finding a galco wallet holster for an American Derringer DA 38 that I own. From the research that I have done, this type of holster in which the gun can be fired from without removing the gun from the holster is banned from the ATF to be carried or used with the firearm.

Is this true?

Is there any way possible to make this combination legal; so the holster and gun can be used together.

All the info on this I can get would be great.

I know a guy that shoots at the local range that is making Kydex pocket holsters. They are open on one side so you can see it is a gun when pulled out, but in your pocket it looks like a wallet. I thought was illegal also, but he told me several officers have seen it and since it is not totally covering the gun he is okay. Can't say for sure if he is correct, but I have not seen a leather pocket wallet for the Beretta .22's and Keltec for a long time.
