VPC brief in Emerson case

I've barely scanned it, but it's the usual, "We already decided this, and you can't re-examine it!" dreck. Shouldn't be difficult to refute it, if the Fifth circuit is going to take this case seriously enough to actually CONSIDER the pro-Emerson arguments.

If the Appeals Court doesnt consider it will the lower court decision become the law of the land is this district/circuit?

Yes...if the 5th District ignores it Emerson wins. Remember, the Feds appealed the original Judge's decision to toss the case.

If the 5th does indeed hear it, then it can go either way..but, it will then likely go to the Supreme Court cuz either the Feds or Emerson would surely appeal.

I like this one...people will have to earn their paychecks {evil grin} and pay the piper
