The United States of America is not a signatory on this protocol, nor has it been ratified by congress.

It's still dangerous, as the Supreme Court can intrepret it as international law and thus binding on the US.

I just skimmed over it, but it looks like US law is already more or less in accordance with the provisions of this protocol.
