As a matter of fact, I have.
I noticed a similar sign in a “Uncle Barney’s” hamburger joint in south San Antonio last year. I asked the folks working the counter if they really derived 51% of their income from the sale of alcohol. They told me that they received no where near 51% from alcohol sales and more like 10-20%. This sign/law applies only to alcohol consumed on the premises. The vast majority of income was from food sales alone. They also mentioned that TABC had instructed them to use that particular signage.
I proceeded to talk to a TABC agent in Austin about this situation (the phone number is on the sign) and he said he would investigate the matter. He called back and told me that the business certainly did not qualify for the 51% sign and he told me that he instructed them to remove it and replace it with the correct signage.
The 51% sign is still hanging on the wall behind the counter at “Barney’s”. My friends and I will not patronize this establishment. Personally, I would rather go hungry than spend one dime in this joint.
