Last Week My Brother In Law Went To Purchase A Handgun At A Local Gun Store And His Background Check Came Back As A Denial. He Has No Criminal Record (just A Few Minor Traffic Violations), But He Said That He Did Get A Speeding Ticket On Recent Out Of Town Trip. He Just Mailed The Payment In The Day Before. Could This Be The Reason For Denial? This Is The Only Thing We Could Think Of. We Live In Tennessee But The Ticket Was In Mississippi. Any Other I Deas Of Why A Man Who Has No Criminal Record, No Military Discharge Or Mental Illness Would Get Denied? Im Confused.

My Buddy At The Gun Store Said That If You Owe Any Money To The State For Any Reason They Will Deny You. He Said That A Guy Had Come In The Week Before And Was Turned Down Because Of A "red Light Camera Ticket" That He Had Not Yet Received In The Mail. So I Guess They Can But An Out Of State Speeding Ticket Sounds Like A Bit Of A Stretch....
 
i guess i should have specified that he has bought two handguns in the past (most recent was about a year ago) and i know him very well. i highly doubt the guy is lying about his past but i would think the same thing at first glance.

What state? This happened to me in Florida.

You can be flagged by the background check system if you with too many similarities to someone who has a record. i.e. names, birthdays, etc.

In this case you will be denied. You then have to file an appeal with the FBI after being fingerprinted.

I went through this process, and it took about 3 months to clear up.

To this day, I am always delayed several hours minimum, and sometimes overnight. So it is "instant" only for some.

If all is well, he should follow through with an appeal.
 
I have been delayed for buying alot in a short period of time but not denied. Maybe he is on the new Barack Administrations right wing radical watch list:D
 
I have often been delayed but not denied. I think the government is still hacked about that Custer thing. Maybe I should mark "white".
 
Apply for you concealed weapons permit. Most states follow the fed rules that allow bypassing a background check if you have a CCW. Reason of course is that you did an extensive background check to get the CCW.

One Caveat. Some towns mandate that their FFL dealers still do a background check on an individual even if they have a CCW. Just in case the CCW has been revoked and the individual still possesses the CCW card. Anyway; if your BIL was thinking of getting a CCW, that could take care of the problem of background checks in the future.

I also was denied several years ago. Never had a brush with the law of any kind in my life. I filed an appeal and sent fingerprints. Took about 90 days to clear it up. Come to find out, I was too closely matched with a serious felon from Indiana. I have purchased several handguns since and never even a delay. Who says they don't keep information?

Also,someone might actually have stolen your brothers identity etc.as well.

( social security number,home address,phone number,especially if he posts it on the internet without a quality antivirus,malware program on his home computer)

And THAT is a whole 'nother ball of nightmare he will have to get fixed if it has happened.

The computer that checks your social security mnumber or just your name especially does'nt know you from jack-it just knows that somewhere in 6 billion people,there is someone with your name on a security hitlist and that person does'nt get to buy a handgun.

Now you have to show that you are not THAT person they are looking to deny a handgun too.
 
If you give your Social Security Number they can't confuse you with someone else unless there's someone else using your number. Tell him to do it again with the SSN if he didn't last time, if that doesn't work, go and get the ticket delt with then try again. You might be in a pretty gun crazy state too, those states use any reason they can to deny someone.

Edit: By Federal standards, anyone thought to possibly be a habitual drug user, either by involuntary commitment to a drug rehab facility or anyone with serious or more than one menial drug offense on their record can be denied. The fed doesn't enforce it for little misdemeanors with marijuana and alcohol, but anything heavier they do. And it's a possibility that the state could be using that same federal standard to deny him.

That's a forum-software thing -- if you type an entire post in all caps, the forum software automatically translates it to capitalize only the first letter of each word. I dunno why it doesn't use sentence case instead of title case, but that's the scoop.

I was turned turned down when a I was buying my Kahr a couple months ago. I was in my police uniform at the time and I asked that he double check for me. I made sure to listen in on the second phone call only to discover that the salesman was repeatedly spelling my name wrong.

DON'T BOTHER READING IT CORRECTLY OFF THE APPLICATION, MY LICENSE, OR MY NAME TAG EINSTEIN!!! Sheesh. Needless to say, it was straightened out at that very moment and I got my gun.

I didn't give my social security number.

I would pay to see a cop in uniform get turned down on a background check. In my city I wouldn't be surprised to see it happen at my local gun shop. Maybe I should take some popcorn next time I go in just in case.
