How would two people do this and still be able to protect themselves from being ripped off? do they have to be shipped by an ffl?can the be sent certified through the mail or go through fed-ex? thanks

You must have gun shipped to an FFL,Agree to a 3 day examination period and have FFL hold and send Certified money order when all parties are satisfied. :)

I learned from talking to my FFL last week that shipping to FFL only satisfies Federal requirements. Each state can impose its own additioanl regulations and waiting periods.

The best advise I can give you is to do it through your local FFL. This way he will take care of all the legal paperwork.

If the guns fall into the Curio and Relic category and this is a regular thing, the parties can obtain Collectors FFLs, allowing direct exchange without the need to go through an FFL dealer.

I have always sent certified funds to the seller return receipt requested. This insures the person received the funds and you get a green post card back that says the postman delivered it to them signed by them. If they fail to ship it is mail fraud and a federal offense. Contact the postal inspectors with your little green card and the SOB will be placed under arrest. Always request a 3 day inspection on a used gun, that is 3 business days from the day the your dealer signs for it not from the day you find the time to go pick it up 2 weeks after it arrives. Even if it is a used gun you do NOT get to go shoot it as part of your inspection. If you return it, it must be returned exactly was it was received.

A reputable FFL is surely your safest bet. Once sold, they will be responsible for any background checks and enforcement of their state laws. The FFL will most likely charge a fee, which should be paid by the buyer, not the seller. There are a few places I have heard of online that allow people to transfer funds for private party sales electronically, but I have no personal experience with them.
