Anyways guy is a corrections officer and here in Missouri like alot of other states you must first get a permit for each pistol you buy. Anyways most counties takes just a few minutes some up to 10 days.

Anyways a judge ordered this guy 96 hr evaulation in a looney bin, not committed just a eval, and the hospital said there was nothing wrong with him. Anyways according to the law only when you are commited to a mental hospital your gun rights are taken away.

Anyways this county denied his permit, and he went to appeal it and the local judge denied it to him also so he had to go all the way to state supreme Court which voted 7-0 in his favor and granted him a permit.

Thats kinda scary when you think of it. Like imagine if you got a divorce and the mother is mad at you and says crazy stuff and the judge orders you to a eval and a mental hospital to see if your fit. the judges order still goes into the computer system.

Hopefully on the Federal Level they dont denie this poor guy and he has to then appeal to the FBI his case.

Another example how gun control, and background checks are intrusive and infringe on our right to bare arms.

What more I hate it when you call in NICS check and they delay they dont tell the person the reason why.

I consider NICS "the beast" as Dale Gribble calls these super computers on king of the hill.
 
Court overturns denial of gun permit to man once detained in mental ward

As a Missouri corrections officer for more than 10 years, David Nelson is authorized to carry a gun on the job. But a year ago, he was denied a state permit to buy one.

The contradiction became a court dispute that reached all the way to the seven judges of the Missouri Supreme Court, who ruled unanimously Tuesday in Nelson's favor.

The issue dates to Sept. 11, 2003, when a judge in Callaway County ordered that Nelson be detained, evaluated and treated at a mental institution for 96 hours, against his will, because a Fulton police officer alleged that Nelson had talked about suicide.

In that period, the Mid-Missouri Mental Health Center determined that Nelson did not suffer from mental illness and needed neither medication nor psychiatric care. He never got a court hearing to protest the police officer's claim.
On April 27, 2005, Nelson applied for a permit to acquire a concealable weapon, which is different from a concealed-carry permit but is bound by similar rules. The Callaway County Sheriff's Department said no. Sheriff Dennis Crane, and later Prosecuting Attorney Robert Sterner, cited a state law that denies permits to felons or people having been committed to mental institutions.

Nelson sued, losing before Associate Circuit Judge Joe Holt, who had issued the detention order, and then before Circuit Judge Ellen Roper.

Nelson's attorney, Geoffrey Preckshot, took the case to the Supreme Court, arguing that the ruling was unfair to his client and others in a similar situation. "Each of these persons is caught in an almost classic 'Catch 22'; never again to be trusted by society to be allowed to acquire a concealable firearm, but not crazy enough to justify a (commitment) proceeding," he said.

Writing for the unanimous court, Judge Richard B. Teitelman said Nelson had been put under "detention," which he said is different from "committed."
 
yeah 2 years is a long time to wait for a permit/license. here in south africa, i have been waiting over 2 and a half years to get my license. still waiting. chances are i wont get it at all.
there are laws here allowing joe public to own and carry a gun, but for the last 2 years there have been VERY few licenses issued; barely in triple figures. bear in mind thats covering the whole country not a single province.
the majority of people will apply for a license, get refused a year or two down the line, then appeal the decision, wait another two years or so and still be refused.
in short its basically impossible to get a license to own a gun here. the only other option is to obtain one by other than legal means. for me thats not acceptable, because i will be leaveing for the U.S soon and want to keep a clean record
 
In MO you need a permit for each gun? I've never heard of that, not even for CA. Is this seperate from the waiting period? There is a difference between a background check + waiting period and a permit.

Dre_sa, is the permit that you speak of for owning a gun or carrying a gun? Or seperate licenses that they are not issuing?

Sorry, read second post. You actually need a seperate permit to own a gun that can be concealed in MO? I've never heard of such a thing either. How is this defined? Do they have a box similar to the IDPA box?
 
In Missouri its called "Permit to aquire" You can get as many as you want at one time if you want, but you need one for each gun because you can only list one gun on it. Its stupid. At the very least they could make it so you could list as many guns as you want on it since its the same name. I know states like Nebraska, NC, have a similar setup. Alot of counties in MO you can just go to any sub station and ten minutes you get your permit, if you live in St. Louis county or City, or KC it can take up to two weeks because here in Stl county they do the background check at HQ in Clayton. Then you ahve yo wait until they send you a letter saying you can pick it up. If you dont have the letter they wont give you the permit because they say you need to have the letter proving your residence:(

I had this problem. I filled out a Permit at police HQ. It normally takes 5 days if you fill it out at HQ, so anyways two weeks later I never got my letter in the mail, so I drove 30 minutes to HQ, spent 20 minutes trying to find parking, then when I got there I told the clerk at the county and he goes and gets the permit. Says it was approved over a week ago and I todl him I never got the letter, anyways he refuses to give me my permit despite having my ID on me with my current addy saying I need the letter proving my residence. Anyways he refused to issue the permit to me and said wait until we send another letter. I asked to speak with his superviser he says hes gone for the day, then I asked I want to speak to a Lt or someone higher up because Missouri law says they have up to 7 days then they must issue the permit. St Louis county has broken the law for years making you wait up to 10 days.

St. Louis county and their former cheif was also the major roadblock in getting missouri CCW law passed. back in 2004 he was bitter in court saying he doesnt feel the public needs to carry guns and thats the police job to protect them.
 
it is infact a license to own a firearm. we get one license per firearm, assuming that you have more than one. we do not get permits to carry, it is assumed that if you own a firearm you may use it for any lawful purpose, that includes carrying. however we are not allowed to open carry, it has to be concealed.

I know I come in here and appear to be real capricious in my decisions. The fact of the matter is that we're not capricoious; Like Y'all we're ALL real limited in our time. When we see a transgression, we act on it.

Personally, my language amongst friends would make a Sailor blush.....but I hardly consider that to be my measure "in the Polite Company of Strangers".
