Texas legislatures File Lawsuit

Dear CLDF Supporters,
In our last update regarding our lawsuit against the cities trying to bankrupt the gun industry, we mentioned that the lawsuit would be filed in mid-September. Unfortunately, that didn't happen. Let us tell you why.

First, the good news.

American Derringer CEO, Elizabeth Saunders, has recently agreed to join as a plaintiff against the cities that are trying to bankrupt her company and infringe upon your rights. This development required us to do additional legal work to account for Derringer's unique situation. The Second Amendment wouldn't be in such jeopardy if we had more people in this country with the patriotic fervor and the courage of Elizabeth Saunders.

We are also pleased to announce that we now have 26 Texas legislators who have agreed to be plaintiffs in this case. We expect this list to grow to 30 or more over the next several weeks.

Now, the unfortunate news.

Since February, a major Texas law firm has been in charge of our legal work. While our fundraising efforts thus far enabled us to have the lawsuit drafted, we have not raised enough money to pay the amount they required to file the lawsuit. As such, we were forced to find new legal counsel willing to handle this case with very little money in advance, which played a large part in the delay of the filing of the lawsuit; however, we were fortunate enough to find attorneys who truly believe in your right to keep and bear arms. They believe in the importance of this case and are willing to go the extra mile to make this effort a success. Because of their hard work and your past support, the lawsuit to save the 2nd Amendment, will be filed on November 15th.

Now, we need for you to go the extra mile. We understand that the holidays are quickly approaching and that funds are scarce, but we also understand that the greatest possible gift you can give your family and friends is the gift of Freedom.

Here are the facts.

Three manufacturers have already filed for bankruptcy protection - others are contemplating the same as we speak; several manufacturers have stopped selling handguns to civilians; prices are skyrocketing; and gun stores are going out of business. And let's not forget the infamous Smith & Wesson Agreement. An agreement that if eventually forced upon the entire industry, will require all firearm purchasers to undergo government-approved training; it will require all sales to be recorded in a database linked to the BATF; it will require all firearms sold to be equipped with "smart-gun technology" within three years; and even more amazing, is the requirement that the manufacturers use 1% of their gross income to fund anti-gun propaganda.

This week, Smith & Wesson was forced to lay off 125 hard-working men and women in Springfield, Massachusetts. Despite our feelings about the Smith & Wesson leadership, these are good folks who lost their livelihood because of the actions of self-promoting politicians and billionaire trial lawyers who have violated the basic tenets of the U.S. Constitution.

We want to put a stop, once and for all, to the attempts by litigious attorneys to hold lawful industries liable for the criminal misuse of their products. If we do not stop them now, the alcohol, automotive, and countless other industries will be attacked next, sending prices skyward and affecting the availability and affordability of products for the average consumer.

The question has become - are we going to allow 31 cities and the state of New York to use taxpayer money to destroy our right to keep and bear arms? Will we allow them to take away our god-given right to self-defense and our ability to keep a tyrannical government in check? Will we allow them to destroy the Constitution of this great nation? The Second Amendment is the defender of the rest - when it is destroyed, freedom as we know it will meet a perilous fate.

What 'several gun manufacturers' have stopped selling handguns to the public? If they mean Lorcin who closed its doors, the former owner has started a new gun company. I have no sympathies for gun companies who are having problems if the make a gun that goes off when you drop it as happened with a Davis derringer in Ga. a couple of years ago. When someone says things this way it sounds like a scare tactic. I saw dealers at gun shows back in the summer of 1994 claiming that the mags they had were banned. I pointed out that the legislation had not passed and they admitted that it hadn't. They were sensationalizing it to get money out of the gun show customers. This sounds suspiciously familiar. Ruger, S&W, Colt, SIG, H&K, American Derringer, Magnum Research, Kel-Tec, Kahr, CZ, Thompson-Center, Springfield Armory, and others still sell guns. I would think that if a company stopped commercial sales that we would have heard about it.
