I have been reading for hours and still don't fully understand the carry of a handgun in your car "concealed" without a concealed licenses. I have read that you have to be traveling to carry it, and i have read you can be going across town. I have also read that you can still be taken to jail either way and let the courts settle it. I really dont want to go to jail tho so can anyone explain this?

They took out the "traveling" language.

There are stories from Houston of the cops arresting anyone with a gun and letting the courts sort it out. Because of that, the legislature clarified the language. You can have a concealed handgun in your car as long as you're not in a gang, not committing a serious crime, and can legally own a handgun.

And the way that it has been explained to myself is that you can carry on your person as long as the weapon is concealed, and traveling has been taken out of the equation...

u can carry it in your car as long as:
not a felon
must be concealed
has to be personal vehicle, not company car (i THINK)
not a gangbanger

You dont have to tell LEO if u get pulled over, unless you have a CHL.

stay safe...

I would use the millitary rule; don't ask, don't tell. If you are going to be searched or your car, then telling would negate a nasty surprise.

You will be happy to know you can carry a handgun, illegal knife, or cub in the car concealed now except if you are a known gang member then you can only carry the club and illegal knife (or if you are a convicted felon or one convicted of domestic violence then you can't posess any guns.)

So of you have a sword, spear, 5.5inch or longer knife, dirk, dagger, nachuka sticks, etc... and you can find a way to conceal them, yep you can carry them... even if a known gang member.

pretty sure you cant conceal it on your person even in your car if you dont have a chl...i would do some pretty thorough checking before i tried that..

The TX penal code does not distinguish between loaded and unloaded firearms.

The new law states only that the handgun must be concealed. There is no prohibition against concealing it on your person while you are in your vehicle. This could cause some problems, however. If, for example, you are in a traffic stop and the officer asks you to step out of your vehicle you could find yourself in a bit of a dilemma...

Here is the applicable section of law.

I haven't sat down and tried to carefully figure out how the new law affects the posession/carry of other illegal weapons in vehicles, but at first glance it would seem that they don't fall under the same concealment requirement that applies to handguns.

I find the 'gang member' part just totally silly....

do gang bangers carry membership cards? I think this is skirting a lot of civil liberties.... So, because the powers that be don't like the private club you belong to, they call you a 'gang' member?

There is a specific legal definition for gang member in the TX statutes.

http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.71.htm#71.01
"(d) "Criminal street gang" means three or more persons having a common identifying sign or symbol or an identifiable leadership who continuously or regularly associate in the commission of criminal activities."

Let's eliminate all the confusion by eliminating all the gang members..... Let me know when it's time to get started I can be there in 24 hours......ummm God bless Texas.
