Texas CHL signage question

I just got home (Louisiana) from a trip to Austin. I saw more signs there about CCW's than I have at home in the past six months! Anyway, I did some research about the CHL laws in Texas before I left and I read about the "30.06" sign and I read about the "51%" (alcohol sales) sign.

But when I was leaving an Outback steakhouse, I noticed a sign that read:

"Possession of an unlicenced firearm on these premesis is a felony punishable blah, blah, blah..."

What is that sign? I didn't see it when I was going in because of where it was placed.

While we're at it, why is open carry illegal in Texas? With all that open farm land I'd think it would be.

More than likely politics. Was it not gwb and gonzales who supported the assault weapons ban in early '05 with gonzales saying that he was in favor of even strictor gun laws?????????????

The Outback sign is irrelevant to CHL folks.

About open carry - if the land is private - do what you want. That's different from walking down the street. If the land owner says OK - you are good to go.

There is very little nonprivate open space in TX.

I haven't been to Austin since I got my CHL. My Austinloving friends there say "Austin doesn't like guns. It's a gun free city.:barf: " Wouldn't surprise me. Since the late 60s....and even to a certain extent from the beginning of Texas that area has been dominated by a liberal element opposite from real Texas. Kinda like Atlanta is to the rest of Georgia. Austin and Atlanta are very unSouthern.

So that sign about unlicenced possession was just to scare people who carry without a permit? Are the fines and penalties in those locations more severe than, say, in a Denny's that doesn't have that sign?

Also, is it true that the official "30.06" sign has to be posted for a business owner to prohibit CHL'ers from carrying in their business? Here in Louisiana a business owner can put up any sign that denotes they don't want people to carry on their premesis and it's legally binding.

I ask because I do plan to return to Austin on trips from time to time. Austin is a nice city, gun unfriendly, but nice.

Basically. The penalty is enhanced where alcohol is served, which is basically what the sign says. CHL only has to worry about places that derive 51% or more of income from alcohol sales (essentially bars).

Only the the 30.06 sign is valid for keeping CHLs off of private property. That or they have to verbally tell you.

Kinda like Atlanta is to the rest of Georgia. Austin and Atlanta are very unSouthern.
Depends on whether you are talking about just Atlanta, or the outlying 'burbs. Atlanta itself is like you say. But if you get away from the inner city urban part (esp DeKalb and the southern part of Fulton counties), then it really isn't really like that, but more like any other sunbelt suburban sprawl. An awful lot of the greater Atlanta area does not walk lock-step with inner city Atlanta, especially a broad arc outside of "The Perimeter" that extends all the way from the far west side over to the northeast side, or in the outskirts in any direction you choose. In other words, it ain't like that at all in the part that I live in.

That's the truth and I have seen very few although I have seen a couple that tried but failed to meet the requirements.

"PURSUANT TO SECTION 30.06, PENAL CODE (TRESPASS BY HOLDER OF A LICENSE TO CARRY A CONCEALED HANDGUN) A PERSON LICENSED UNDER SUBCHAPTER H, CHAPTER 411, GOVERNMENT CODE (CONCEALED HANDGUN LAW), MAY NOT ENTER THIS PROPERTY WITH A CONCEALED HANDGUN."

"CONFORME A LA SECCIÓN 30.06 DEL CÔDIGO PENAL (TRASPASAR PORTANDO ARMAS DE FUEGO) PERSONAS CON LICENCIA BAJO DEL SUB-CAPITULO H, CAPITULO 411, CODIGO DE GOBIERNO (LEY DE PORTAR ARMAS), NO DEBEN ENTRAR A ESTA PROPIEDAD PORTANDO UN ARMA DE FUEGO."

Penal Code Section 30.06(c)(3)(B) further states that a sign must meet the following requirements:

includes the language described by Paragraph (A) in both English and Spanish;

appears in contrasting colors with block letters at least one inch in height; and

is displayed in a conspicuous manner clearly visible to the public.

There are very few 30.06 signs in Austin. While the gun crowd may cower and shake at the thought of entering 'liberal' Austin, it's really not a hassle at all as compared to any other major Texas city.

In fact, the change to the 30.06 signs took down many of the older no gun signs and there are a few noncompliant 30.06oid signs out there that seem not to mean squat.

Austin is a fun town. One can stay in their double wide and worry about liberals or go to town. :D

nemesis

Has posted an excellent summary of the situation.

I have seen very few 30.06 signs, and of those I have seen more that half fail to meet the criterion set forth in the law to be valid.

While I was in Austin I did see any 30.06 signs, but I did see alot of those "Unlicenced possession" and non-government "no guns" signs (i.e. gun with the red circle/cossbar).

It's not as friendly as New Orleans, but it's better than most.

Next time I go, I'll be better prepared.

I see very few "correct" 30.06 signs. Some places have a 4 by 6 inch sticker on the window that is a mini version of the sign. Those don't mean anything. Some have a full size sign with the correct size letters, but only in English. Those don't mean anything either.

I don't carry when I go out to bars, but other than that I haven't had any concealed carry related problems when I'm going around town.

The sign you saw does actually mean something, but not for concealed carry folk. If you are illegally carrying a gun, it's just one more thing they can throw at you.

Glad to hear the Yankees/liberals didn't burn all Southerners out of Atlanta back in 1864. ;)

Katy Mills Mall in Katy Texas just west of Houston (a very liberal yankeeized/yuppieized town with a dwindling Southern farming/cattle poppulation) is the only private business around my area that I've ever encountered a 30.06 sign. Won't be shopping there anymore.

My brother lives in Katy, on the other side of the freeway from Katy Mills. So yes, I know all about Katy, been there often, I grew up in the Houston area after all. My only problem with avoiding Katy Mills completely is that Bass Pro Shops is there. The equivalent to Katy Mills in the Atlanta area is Discover Mills over on I-85 in Norcross (other side of town from here). No such sign silliness there.

Having lived int Texas from 96-05 (El Paso & San Antonio), I can honsetly say that Austin is the last bastion of liberalism in Texas

:D
