Action needed immediately! -

Senate Bill SB717 (to stop the frivolous gun maker lawsuits) was
tabled again this morning. The Texas Trial Lawyers have gotten to

Bernsen is a trial lawyer himself, but he is also pro gun. He had
offered to be our champion in the Senate. Some champion, huh?

At any rate, we don't want to quit now on this very important piece of
legislation. We need to hammer Senators Bernsen, Ratliff, Sibley and
Whitmire, as well as our individual senators. The Senate probably
won't put up with much more tabling, if any.

Two years ago, we jammed the senate fax machine and telephone
lines. In the end, those contacts had the desired effect and we got an
improved CHLaw.

Can we do it again or are we going to let a bunch of trial lawyers
hold the fort? Do it all - CALL plus FAX plus E-mail.

Done deal here also! According to Senator Eddie Lucio's office the vote is at 10:00 CST today. Call early and call often!
 
Thanks for all of your hard work!!!The vote was postponed untill Tuesday. Things are looking good, but we need to keep the heat on untill the end. Your immediate action is needed to push through a vital protective
measure for your right to keep and bear arms. Please contact the
state Senators listed below and your own state Senator if he or she
is not on the special list.

GOA has included a clip and Fax or copy and E-mail message to
facilitate your response action.

If you prefer to do so, please write your own message but remember
the one you actually send is better than the masterpiece that never
gets sent.

One Senator, Bill Ratliff, objects to the idea that the Texas
Attorney General would be prohibited from engaging in these
frivolous lawsuits. It seems that Mr. Ratliff doesn't like to have
the hands of the AG "tied" by legislative restrictions, which
protect your freedom.

Ask Senator Ratliff if he also objects to having the powers of
government "tied" by the chains of constitutional law. If he
doesn't, then you'll know why he opposes a clean lawsuit bill
because he wants a worthless one.

As city after city falls prey to greed and sues the gun industry,
state legislatures are reacting. One by one, state legislators are
coming forth with bills to prevent these frivolous lawsuits from
going forward. You are receiving this alert because Texas has had
such a bill in the works-- SB 717.

Your tax dollars, even if you don't live in the municipality which
is suing, are being used to fund the judicial destruction of your
gun rights. "How so," you ask?

Quite simply most U.S. cities, towns and/or counties are on the
federal and/or state dole in the form of grants and loans. If you
pay state and federal taxes of any kind you're funding these
ridiculous and dangerous lawsuits.

Money is fungible!

So gun owners across the states are fighting back. The legislature
of Texas can clearly restrain what its agents-- municipalities-- do
with their power and your tax dollars.

GOA would also like to see a "loser pays" rule for suits involving
certain private parties who bring frivolous, strict liability
lawsuits.

Such legislation is important because it offers the gun industry
protection from unwarranted liability. If a gun works, the
manufacturer cannot be held liable. It's that simple, really. The
present lawsuits wrongly claim that since the gun worked properly,
the manufacturer is responsible for someone else's misuse of it!!!

Thankfully, there are pro-gunners in Texas that have taken the bull
by the horns and said, "stop these foolish lawsuits!" You MUST show
the legislature your support!! Please read on and take the
recommended action.

Please take the actions below and help to stop these dangerous,
freedom-robbing lawsuits from going forward.

As this is written SB 717 has been tabled and is being held for
further action. Here is what to do:

to pass SB 717. I urge you specifically to oppose any more efforts
to table this bill.

Frivolous lawsuits designed to plunder, if not shut down, the
businesses which make firearms are a threat to my rights and safety.
The small businessmen and workers who make the products which save
lives and thwart over a million crimes a year deserve protection
from greedy government officials.

Please stop municipalities and state officials from using my tax
dollars to fund the lawsuits.

Proud to say the nice lady in my State Senator's office says Sen. Jeff Wentworth fully supports SB717. Noted that my wife, mother, two daughters, future son-in-law and I (6 votes) have consistently supported Sen. Wentworth, in the past.

Now, we (that's WE) ask the Senator to:
1) fix the potholes in our streets,
2) pick up the garbage,
3) put more cops on the street,
4) buy the cops GOOD bulletproof vests,
5) put the violent crooks in jail & keep them there, and
6) stop wasting our time, money, and efforts suing the gun manufactuers.

We need to keep the pressure on the Texas State Senantors for just a while longer. They are going to vote on this bill sometime Tuesday. We need one to give them one more last burst of calls/faxes/and emails right before they vote. Let's keep the pressure on til the end.

All the info you need is on your voter's registration card.
Using your local address, you can get the information from your local tax office, local library, local magistrate (e.g.Justice of the Peace). It may even be in the blue pages of your phone book (if your phone book is like ours....) Call your local Court House or you could contact your local "Friends of NRA", or even the NRA itself. Any others?? :)

Senate Bill SB 717 has been tabled once again because of a point of order
that did not get it on the calendar. It is scheduled for tomorrow (Wednesday).
Allegedly the Trial Lawyers Assoc. is stalling to gain more support from others
outside of their association. Unconfirmed rumor has it that the Municipal League
has joined with the Trial Lawyers Association.

This is certainly an ideal time to send your Senator another Fax, E-mail, or
make a telephone call. The effort is worth it. Even if you have already contacted
your Senator, it is time to contact them again to keep their support for SB717.

Congressman Rick Green says he has the votes to get the Hupp/Green HB 1716 passed through
the House. (HB1716 is the House version of SB717).
