Taxes on online Gun purchase?

Hi Guys. I tried a search on this but couldn't really find anything. I am purchasing my first firearm, Sig 229R and have found some great deals NIB sigs online. My question is... do I have to pay taxes on this? I was told by one shop here that they would receive a transfer for me, but I would have to pay them $35 plus tax. Are guns different than other things you buy online? Because if I buy something out of state online I usually don't have to pay taxes. Thanks in advance! This has been a great forum to search through for info.

NO and no.....

....internet sales by FFL dealers involve no tax collection....it is up to you to tell your state (when you do your taxes) that you owe whatever in sales tax; your receiving FFL dealer is not supposed to collect taxes, since he DID NOT make the sale, so I suggest you find another FFL...the only internet purchase where I had to pay taxes was with GSSF, where I purchased a Glock, and they are set up to collect taxes for a variety of states...otherwise, out of state retail concerns are not obligated to collect taxes for out of state internet purchases.;)

As you aren't a Class ! FFL, the transfer has to take place in a legal dealers store. The weapon will be entered into his Bound Book, and will become part of his inventory. When it is transferred to you, you pay his fee, and you pay taxes as though you bought the weapon from him, rather than from some out-pf-state entity. Just the way it works.:)

How can the dealer know how much sales tax to charge if he doesn't know how much you bought it for?

Serious question. :)

I've done more transfers than I can count here in Florida, from different dealers, and have never heard of this. Is it possible it depends on the laws in your state?

It's possible.....

....what state you are in....I have sold and sent to ffl dealers in Florida, and not once has the purchaser been charged taxes by the receiving ffl dealer...I have also purchased upwards of 12 pistols from a variety of out of state stores, and had same transferred to 2 or 3 FFL stores I deal with, and again, was not charged taxes for the purchase...just the $25.00 transfer fee. Technically, one informs the state of purchases made on the internet where sales taxes were not collected by the internet business when doing your annual taxes...enforcement, though, is...well....who knows.

This was in Maryland, and the Atty General was on his high horse over lost sales taxes via the Internet. In Maryland, the FFL was expected to tax you on the paid value of the weapon. Mine was $10.00. He was happy, and so was I.:)

The dealer can charge you sales tax on what he sold you; nothing more. If YOU purchased and paid for the firearm from the out of state source, your dealer can only charge sales tax on the service he rendered (the transfer). Since YOU bought and paid for it, he has no taxable basis in it; IOW he cannot charge you sales tax on something he did not sell. If your dealer paid for the firearm from the out-of state source and then transfered it to you, he can charge you tax on both the firearm and the service of the transfer.

My last interstate transaction was $30 shipping and $20 for my FFL to fill out the paperwork. No taxes. He didn't sell me the gun (someone in Nebraska did). He was just the legal receiver for me. Since the gun was $600, I didn't mind paying the $50 in shipping and FFL charges. I didn't buy it in Ohio, so no sales tax.

If you buy something out of state and they don't charge

you for your sales tax, which then they would pay to your state. You are actually supposed to pay the sales tax to your tax people.

Paying taxes

Here in Wa. State sales have to go through a ffl dealer. The State requirwes him or her to collect the taxes for the state. Taxes are 7.5 of the cost.
James:) ;) :o
