SWAT's at the door again

The debate about resisting SWAT was rather heated and confused so I want to ask a crystal clear scenario that avoids the problem of the fake police raid.

So:

You are up late at night for some reason. You are in the second floor of your home. You are a good guy. Not a nut or druggie. No record, no illegal stuff in the house.

You hear cars pull up and look out the window and there is the SWAT truck and a bunch of patrol cars. So it is not fake.

The guys in black are charging at your front door. Their jackets say POLICE

Since you are up, you have time to run to the stash and get your FAL or 223 with the 20 round clip as you hear the front door crash in.

So this is an essay test:

1. Do you offer armed resistance?

If so, why?

If so how? In this answer, please comment
on how you will act if after the exchange
of fire, it becomes a siege. Have you
established a safe room with cover
sufficient to protect you and your family?

What are your precautions for gas and
flashbangs?


2. After the action ceases in some manner
and you are alive, please explain your
legal strategy.

Remember that the DA make ask you (if you
take the stand):

Did you not know these were police when
you saw the truck? The officers yelled
they were police - did you not hear them?

If you did make the ID, why did you
resist?

3. Last, assuming that you fend off the
attack and perhaps kill an officer or two
and manage to get a jury that buys
a story that you thought you were in
danger - what really is your moral
justification for taking these
lives? They made a mistake, it might be
honest or stupid - but a mistake.

If you did not resist (remember you
know it is real) then you might get
beat up and get the backside probe
but you probably won't die.

Was it then a deadly force situation?

If you don't want to play, that's cool.
 
If you are home alone and a SWAT team comes crashing through your door, resisting will get you hosed. You can't fight off a tac team and sneak away into the night.
 
Quick answer:

I'd grab the video camera instead and place it in a VERY concealed position that allowed the broadest view of what was happening. (This, of course would take some fore-thought prior to the day of the "invasion") I would also activate the voice activated tape recorder that has been placed out of sight.

Other than that, I would not resist, at that time.

Shin-Tao is right. All you can do is maybe take one or two of them with you. If you try that, you're dead for sure though. Its not a choice between jail or life. It's a choice between jail or death. Me? I'd fire every one of those 20 rounds. Why? I don't believe the media at all. I hear on the media about false/mistake raids. The guys are coming into my house for a specific reason. If I haven't done anything illegal, that is all the more reason for me to worry. That would me they would be pinning something fake on me just to justify arrest/custody in order to do to me whatever they had planned. Nuh-uh, no way am I goin to throw my hands up and fall into their pre-meditated plan. I'll fire and die.

You have an Evac plan set up for you and yours in the event of emergency..right? One of these egress routes is out the back door or some other way than the front ..right?
One possibility is to get you and yours on the way out of there the moment you sense something is off.
Armed confrontations, especially against superior numbers, and even more so when ones family is present, are to be evaded if at all possible.
The best thing is awareness and early warning.
 
Attention all fellow TFL, this post is nothing but disgruntled bait from a so called psychologist...to raise hell with the Leos and the private sector. That is my opinion and I refuse to add to it. We've been down this road before, too many times and all it does is cause hard feelings. It does not bridge the gapping gap that separates us from some tactical swat teams.

Why fan the flames any longer.

What makes you think a SWAT team is not going to cover the back?
 
You know who they are!!!You know you are not guilty of anything.Its not like being waken in the middle of the night by your door being smashed down.Get real.They have the wrong house.Put your hands on top of your head and wait for them to find you.Then do as your told.The rest can be fixed in court.

I will request to see a warrant, per the Constitution. If the warrant is for anything other than firearms/related items, I will peaceably lay down my arms, and offer no resistance. Violent intrusions into my place of abode will be met with force...not because that gets my rocks off, but because I feel it's my duty.
 
Makes me very curious about dead-man triggers...esp. if you live alone, it would be satisfying to blow the place sky-high if you are incapacitated or in custody.

Of course, the next development of this would be feds simply sniping at undesirables a la Holouchi.

One thing we should have is dead-man switches
on our computers - enter the wrong password too many times and the drive gets zapped. If you do it right, they may not be able to prove that you "destroyed evidence".
 
Its pretty clear cut. You know they are cops so you surrender. If you feel they are there for "Bad" things then surrender poutside where the fact that you are unarmed and not resisting can be clearly seen by your neighbors. The basic premise of the other senario was that you DID NOT know that the attacking mob were police and had to make the decision on the fly. Contrary to media hype I dont feel that ALL cops are bad and out to hurt every gun owner, Consitution reader... There are those out there for sure, but the majority of the locals are still good guys.

This has nothing to do with the earlier scenarios. If I see police cars outside, of course I'm not going to resist - you think I'll suicidal or something?

We where talking about being aroused out of a deep sleep by masked men in black, busting down your front door. Totally different situation!

Your scenario - no resistance. My scenario - empty mags as fast as possible, and sacrifice life if necessary, in a desperate attempt to save family from Gang Bangers intent on inflicting bodily harm, rape and murder.

But since you still seem to be missing the point, one more time, just for you -

NO US CITIZEN SHOULD BE REQUIRED TO DETERMINE IF THE MASKED, DARK CLAD INVADERS, BREAKING INTO HIS/HER HOME IN THE MIDDLE OF THE NIGHT, ARE LAW ENFORCEMENT OFFICERS OR BAD GUYS! 4th amendment, 4th amendment, 4th amendment! Why is this so hard for you to understand?
 
If they are at the door and you have no way out - its too late. Your SOL. Dont fight - raise your hands over your head slowly and do what the Officers say... nice and easy.
Anything else is suicide.
