New York State to Become First State to Sue Gun Makers

NEW YORK (AP) - New York is poised to become the first state to sue the gun industry.
New York Attorney General Eliot Spitzer planned to file a lawsuit Monday against manufacturers and wholesalers of firearms, claiming they have violated the state's public-nuisance law.

Thirty-two cities and counties, including New York City, have filed suits against the industry. Many of those actions were filed as negligence claims.

The state's suit, to be filed in State Supreme Court in Manhattan, would take advantage of a New York law that states illegal guns are a public nuisance.

More than a year ago, Spitzer began talks aimed at persuading gunmakers to adopt a code of conduct and change manufacturing and distributing practices to prevent the flow of weapons to criminals.

The code asked gun makers to install gun locks on all the firearms they sell, introduce within three years "smart gun" technology and prohibit the sales of its weapons at gun shows without a background check.

In March, the nation's largest maker of handguns, Smith & Wesson, agreed to adopt the code of conduct and was dropped from the local-government lawsuits. It was not to be named in Spitzer's suit.

But in April, several other large gun companies sued Connecticut, New York and 16 local governments over their bid to have law enforcement agencies buy guns only from manufacturers who upheld to the code of conduct. In May, the gun industry ended negotiations aimed at settling the local government suits.

Spitzer said the suit by the gun industry prompted his action. Among the manufacturers he plans to name as defendants are Glock, Beretta U.S.A., Colt's Manufacturing Co., Taurus, Ruger & Co. and Inratec.

I draw your attention to the list of manufacturers being sued. Why is Kimber not listed? It it because its factory is in Yonkers NY? If guns are a public nuisance as the suit will state, it seems to me all guns are a nuisance, REGARDLESS OF WHERE THEY ARE MADE?

So, when do we reach the point where the government sues businesses to the point where there is no longer enough commerce to support the gov't?

I'm no expert, but isn't this a violation of the Ineterstate Commerce Clause?
 
I hate to say it but, we let this Bozo get elected in the first place. Now we have to live with this joker.

If you recall the count was quite close and it was an off year election.

Ditto for Scummer er... Schumer.

But what do I know, We voted for Pataki too. I think I'm going Libertarian and voting as I see fit on this issue.

We've gotten it from both ends now.

I see Sue Kelly even voted down the latest Hostetler Amendment to stop Reno from enforcing the S&W Agreement.

In this state we are being abandoned wholesale by the Republicans.
 
Since I lived a pretty good amount of my time in Texas growing up I have to say the so-called Republicans in this state really suck. Pataki is turning out to be a real wimp and paternalist. My guess is he wants to be Al Gore's running mate. Otherwise he would have reined in the malfeasant Spitzer and would campaign against America's own Madame Mao.

As you said, Spitzer barely got elected. If we can engineer a recall election it may throw some fear into him and the weak-kneed Republicrats to act like men instead of men-in-skirts.

What happened to the NRA during the second session? It did not seem to be of much help.
 
Supposedly 3 State (R) Senators are to be targeted for defeat this year because of this vote. Don't know which ones yet but will try to find out.

This is supposedly to strike some fear into them and not endanger their majority in the Senate while doing it.

I think Pataki is running scared due to the obvious good showing by Dems in the last election (ie- Scummer and Spitter).

The Repubs in my area Southeast NY seem to be taking a Left turn as of late.

Very difficult with the Ratio of Dems to Repubs being so out of whack in this state.

Hell, times are good and people are too busy making a buck to worry about the erosion of their Constitutional Rights.

Maybe they would get off their asses if they were talking about banning golf. :)
