South Dakota - The Governor has signed HB 1296 that added section 34-48A-5.1 to the state statutes and it went into effect immediately. This provision expanded Firearms protections further than any other state has to my knowledge. You should read it as it will make your day! That makes it seem like they CAN do all those things.

In reality - this is the paragraph that preceeds it:

"No state agency, political subdivision, or any elected or appointed official or
employee of this state or of a political subdivision may, under any governmental authority
or color of law, including any other statutorily authorized responses to disaster, war, acts
of terrorism, or emergencies of whatever kind or nature:"

Changes the whole complexion of those 5 bullet points.

Yes, but that's the entire law, including Section 1, which grants to governor certain emergency powers. Basically, it's a law with a sunset provision, which is something I have always thought to be a good thing.
