So someone steals Your gun .......

I've heard recently of reports where weapons, particularly handguns, that have been stolen in house burglaries and used subsequently in the commision of a crime have resulted in the original owner being prosecuted for failing to keep the gun under lock and key. Speaking as someone whose mother in law has a .38 snub permanently on her nightstand (no safes in sight), should this gun be stolen from its resting place, could misdemeanour or felony charges result as a consequence ?

Mike,

It does differ from state to state, and in addition to the statutory issue, there is the civil issue. Even if the gunowner is not found guilty of any crime, they can still be sued (and lose).
