So what's so different about this case?

As the arguments were winding down, Justice Ginsburg was seen to be dozing for at least 15 minutes. Justices Souter and Alito, who flank Ginsburg in seating arrangements, looked at her but did not wake her up.

Since Ginsburg has just recently come off vacation, she may be suffering from jet lag. Or, the arguments were just too boring... To be fair, Ginsburg will have access to not only transcripts, but the tapes of the orals anyway.

But.

I find this behavior, in a Supreme Court Justice, to be offensive. If a sitting Justice of the highest Court can not at least pretend to be interested in the cases being handled, then I would think it's time to retire.
 
The information is submitted in a written brief to the SCOTUS. I imagine that very few cases are won or lost on the oral arguments. When you get 72 and hearing some windsacks on the floor you will probably make you snooze too. Or it could even be some medicine she is taking or the Doc just prescribed. I agree it was wrong but I dont think it is going to effect the case any.

I am willing to bet that there have been many uninspiring and incompetent oral arguments on the floor of the Supreme Court, and that it was a good thing that the person who wrote the written brief had the brains of the team. There are probably some lawyers who have argured before the SCOTUS and didnt realize when to shut up and found themselves digging the hole deeper.
 
Eghad, I agree it won't make a difference as to how Ginsburg, or any other Justice, decides. Orals, as I understand, are more of a test to see if the litigants know what they are talking about and/or to see how far they really want to go....

But I will not make excuses for totally inappropriate behavior. This was just that.

Eghad, did I say or write that? What I said was that I expect them to at least appear to be interested.
 
All judges do it from time to time. I've sat and watched a very capable judge get put to sleep by a moron.

Too bad the moron was my co-counsel. We had to drop a book to wake her up.
 
How come no one posts about members of congress sleeping? Everytime I flip past c-span when they're showing the chamber I see at least one member snoozing away. I'm not defending her actions, just saying that this is a really really common thing with our government.

Hmmm... All judges are not Supreme Court Justices. All Courts are appealable except for? Yup. Supreme Court.

Seems to me that there is a slight difference here. Being just a layman, guess I don't really get it.
 
If it becomes a habit I'll jump on your wagon in a heartbeat. I just think that it isnt going to make that big a difference in the case. Yes, I am very interested in the case, because I live in one of those districts that is in contention. I think Ms. Ginsberg is probably upset about it more than either of us.
