Shooting victim had obtained court protection

The Associated Press

BIDWELL, Ohio (September 6, 2000 1:01 p.m. EDT http://www.nandotimes.com) - A woman whose estranged husband shot her to death at a school before killing himself had obtained a court protection order accusing him of choking, slapping and threatening to kill her.

Linda Shoemaker, 52, was shot several times by her husband, Frank, 66, Tuesday morning while in her car at Bidwell-Porter Elementary School, where she worked as a cook. She died at the scene.

No students or teachers were in the school when Mrs. Shoemaker was shot. The school was closed Tuesday because of the shooting but classes resumed Wednesday.

Within 30 minutes of the shooting at the school, Shoemaker had shot himself in the head with the same gun he used to kill his wife, Coroner Dr. Daniel Whiteley said. Shoemaker's body was found in a lawn chair in the front yard of his home about eight miles from the school, Whiteley said.

Mrs. Shoemaker, who had recently moved out of their home in Bidwell, was seeking a divorce after 31 years of marriage, officials said.

In her court protection petition, she said her husband had abused her verbally and physically throughout their marriage. She said he had recently begun stalking her and making threatening phone calls.

When I was the supervisor of the Civil Section in the sheriff's department, I served many domestic violence protective orders. Very few "protected persons" ever stopped to wonder if that piece of paper would stop a hollow point. Of those that did, rarely did one take the next logical step of leaving town or arming themselves.

"But the counselor at community action said if you served this he would leave me alone."

Ahh, if I had a nickel for each one....

Boy the paper those protection orders are written on just isn't as strong as it used to be. Lets sue the paper manufacturers.

The frequesnt violation of protective orders by abusers really angers me. I posted a rant about this problem over on the Ms. Boards. I suggested an electronic ankle bracelet for the guy being served the order, coupled with a gadget for the protectee that signals if the bracelet is getting closer. There was some good discussion; we even batted around the suggestion that the bracelet should emit a shock if the guy gets too close.

Knowing how the Ms. Board people react to gun discussion, I didn't suggest arming the protectees, though I would give my sister a gun and some training in such a situation. The other idea I did suggest was a Rottweiler taught to recognize the abuser's scent from the stuff he left behind, and attack it.

Ohio does not have any provisions for Concealed Carry in this case. The restraining order was all the protection she was allowed by Ohio law, even considering the abuse and threats by her ex! She was deemed a victim by the state.

Then again, there's the 'gun free school zone' issue. Even if she did have a carry permit, she would have again been helpless at her place of work.

I hope our state legislators think about how this woman was let down by the system. I hope this shakes them up enough to free up our CCW proposal that has been locked up in committee - on purpose - as a 'favor' to our governor. He promises to veto any CCW bill that makes it to his desk, but there are probably enough votes to override his veto, most coming from his own party! To avoid this embarassment, the committee chair has been holding this piece of legislation up in the committee. Politics!

Maybe instead of an order for protection she should have gotten a Ruger or Glock.
