Seminole absentee ballot trial update

Judge Clark ruled that the case will go to trial tomorrow (12/6) at 08:30 Eastern time.

I watched the last few hours of the pre-trial hearing and BOTH sides are making very strong arguments. It really could go either way. Just so we all know, the plaintiff is arguing to have all 15000 absentee ballots disqualified.

Let me say that, from what I can see, Judge Clark is asking good questions and seems to be behaving in a fair and consistent manner. We shall see...

This is such a non-issue. We are talking about ballot applications not ballots. The reason the Democrats did not have any of these is not because they were overlooked. It is because they didn't have the same glich contrary to what Delusional Idiot Gore said yesterday in one of his many recent appearances.

If the ballots are thrown out, you will see the FL Legislature select the Electors.
 
I better amend that earlier reply. If the Gore Goons find any dirt on the FL Congressional Republicans expect the same thing that happened when Clinton used the 1000 FBI that Hillary copied to silence Lott and others during impeachment.

Facts? No I can't back that last claim up with documentation but I can speculate based on the inaction of the Republicans when a President was allowed to get away with Felony crimes.

The trial is ongoing.

The Democrats are making a production of this thing. The Democratic lead counsel openly stated in court that he wanted to present testimony for the benefit of the cameras in the courtroom "so the public will know the whole story".

IMO, they want this thing to be decided by public opinion, not as a matter of law...

Judge Clark seems to be somewhat favoring the Democrats so far. She has overruled almost all of the Republican objections. We have only seen witnesses for the Democrats at this point, so we will have to see how she handles things when the Republican witnesses are called.

Both sides are still presenting strong arguments. No way to tell how this might turn out yet...

The reading of Sandra Goard's deposition is not looking good. She has admitted to knowing the law changed, that no one was allowed to, or had ever been allowed to, make additions to applications for absentee ballots.

I hope the defendants' lawyers can pull a rabbit out of the hat. If they don't the case will go against Bush. (If I were making the decision, as it stands right now, I would find for the Plaintiff. And I despise Al Gore.)
 
I was told yesterday by an attorney friend that the Association of Trial Lawyers of America ( http://www.atlanet.org ) had sent out a request to the legal community for attorneys to volunteer their time for such lawsuits in Florida. That's right .... ATLA was trolling for attorneys to go down to Flor-i-duh and keep this pot boiling.


So, in this case, the plaintiff is not Gore ... yea, right.

And, Gore just wants to make sure we have a full count of every vote ... yea, right.

No that's every vote for HIM, not every vote that was cast, because they weren't all for him. :rolleyes: I really hate him at this point.
 
I cannot see this case going anywhere despite what the Goard person did or whatever. The votes for Bush, Gore, etc., where cast in good faith by the voters. There is no real reason to disenfranchise 15,000 voters over some technical problem. Was not all this caused by a software program problem involving voter ID numbers getting messed up or something??

This case is begging the Florida Legislature to step in if 15,000 ballots are thrown out, plus another 10,000 from Martin County (another case).
 
It turns out that there is actually legal precedent for this in Florida.

The Democrats have brought in a statistician to give the judge an alternative to throwing out all 15000 ballots. His analysis, if she accepts it, will allow her to only throw out about 1500-1600 Bush ballots. The fact that the Republican lawyers savaged the statistician notwithstanding. They did an excellent job discrediting his conclusions...

Bay and Duval counties are now in play in the courts as well...

The ballot applications were misprinted, leaving out the voter id numbers. The Republican Party in Seminole County had gotten lists of absentee voters likely to vote Republican. The Democrats did the same thing, except their application cards didn't have a mistake on them. _If_ the Gore machine wins this, and wins the election, this will be the ugliest stain on our system since our country was founded. These were not ballots. And Gore has claimed all along that "all votes should be counted." B*st&rd.

The court is in recess for today. Closing arguments are set for tomorrow (12/7) at 13:00 Eastern time.

IMO, this could go either way. Based on the arguments, the judge has no clear path; It wasn't a slam dunk on either side. This will likely be decided on her own interpretation of the applicable laws in this case...

If we could assume a neutral judge, I would venture to guess that the Republicans have the stronger case (as presented in the trial).

What worries me is that she might decide to take the middle road and toss out the number of votes based upon the statistician's assumptions. This will give her an out without leaving the Republicans untouched.

But let's keep in mind that the heavy precedent in the Florida courts is to respect "the will of the voter". She might very well decide to defer to precedent in this case and dismiss...

Monkey Leg has it right.

But, the evening news is still feeding the Americans a false report of this. So if Gore people lose this, the Democrats in America will feel like they got ripped off.

Bay county update:

The Bay county lawsuit was dismissed by the court.

The Republicans were charged with advertising on television that voters could "vote from the comfort of their livingroom". The Democrats viewed this as a violation of the absentee voter laws of Florida. The judge disagreed.

The rulings are delayed until 14:15 Eastern. Judge Clark needed more time to complete her final decision.
