Securely Incased???

First off I am new to the forum, and so far everybody has been great!! Thanx. My question is: What constitutes Securely Incased when driving with an unloaded handgun? Also anybody know the law about traveling out of state without a cwp. Is it legal as long as its Securely Incased?

I think the word you are looking for is "encased."

The answer you will hear most often is "It depends on what state you live in." Until you give us that, I'm afraid we can't help much.

depends upon the state...

encased might be in a lockable container.

might have to be encased and in the truck or in an area not in the immediate reach of the owner

check the states laws......
 
Securely Encased

So Im not the best speller! The state I live in is Utah. What about traveling out of state to (AZ, CO). Sorry for the spelling, Thanx again!!
 
Federal laws state that you must abide by your home state laws and the state that is your end point destination.

If travelling to Florida, you must meet both your home state requirements and the Florida requirements, but not the states between.

Utah is pretty reasonable about how to store weapons while travelling. Ca is not.
 
I'll chime in with a "rule of thumb" here.

If you don't know the local laws of your state or your destination state, the rule of thumb is to store the gun unloaded in a locked case, where the lock is a key-lock built into the case, a key-padlock or combination lock. Ammo should be stored separately from the firearm. Do not store your firearm in the glovebox (or with your car's registration papers).

Research is key here. Utah has pretty reasonable requirements. Colorado can be spotty (especially in urban areas) with more restrictions.

Also beware of the actual, legal wording of the laws. In California, for example, it is illegal to have your pistol magazines loaded, even if they are separated from the gun. (Interestingly enough, loaded speedloaders are okay). Other states may have similarly oddities regarding transporting of firearms.
