Lautenberg Gun Ban Provisions Pushed in South Dakota

Dear South Dakota Gun Rights Supporter,
If you don't act right away, misguided state legislators are going
to pass legislation that imposes an unconstitutional misdemeanor gun
ban on South Dakota residents.
Please act immediately by calling, faxing, e-mailing and writing to
your State Representative.
South Dakota usually doesn't see many anti-gun bills in the
legislature, so two bills to reduce freedom offered in just a few
weeks means your anti-gun enemies are on the move.
Senate Bill 85 has passed the Senate and is now in the House State
Affairs Committee. This bill adds federal-style Lautenberg Gun Ban
language as a reason to deny concealed carry permits in South
Dakota. This bill is being pushed by much the same crowd that
unsuccessfully tried to create a statewide database of concealed
carry permit holders, including Gene Abdallah of Sioux Falls and
Thomas Hennies of Rapid City. Remember those names, as we are bound
to see more of their anti-gun antics.
GOA opposed Lautenberg in Congress, and certainly doesn't think
states should follow suit by denying law-abiding citizens the right
to self-defense simply because they plead guilty to misdemeanor
"domestic abuse" charges.
As we all know, domestic abuse charges are not always real. Many
cities and states require someone to be arrested in the case of any
domestic squabble, regardless of the level of the problem.
Frequently, police will arrest both husband and wife and let the
courts sort it out later. A spouse is then forced to plead guilty
to "domestic abuse" charges in order to save time and money, not
knowing the impact on her right to keep and bear arms.
Only later will she find out that the federal government now bars
her from owning a firearm, or, if this bills passes, that South
Dakota won't let her get a concealed carry permit to defend herself
from an abusive husband.
Even worse, the Lautenberg-style disqualification is retroactive, so
a 20-year old bogus charge makes you a second-class citizen.

What kind of events lead to domestic abuse charges? Some are
certainly real cases of physical abuse, but many people are
convicted for such things as spanking a child, having an argument
with a spouse, verbal abuse, and the list goes on. With social
service agencies turning every bump and scrape of a toddler into a
potential child abuse case, American citizens are under assault by
the very government they fund.
This bill may not fit within the South Dakota Constitution, since it
retroactively applies the Domestic Confiscation Gun Ban. Whether it
is unconstitutional or not, this is very bad legislation that needs
to be defeated immediately.
What you can do:
Call these members of the House State Affairs Committee at
605-773-3851 and urge them to vote against Senate Bill 85. Tell
them you don't want anti-gun federal language inserted in South
Dakota law. You can also call them at home this weekend with the
numbers following their names (Saturday evening is the best time).
