Sales Tax at Gun Shows

Is an out-of-state dealer, doing business at a show, required to collect sales tax(for the jurisdiction of the show)? Some merchants have claimed they MUST collect, and others don't ask for it. I should think it would be like any other mail-order purchase, as they are not licensed to do business in my state.
 
As nearly as I can determine, if a business has a STORE FRONT or OFFICE in the state, they are required to collect sales tax, else not.
 
Several years ago the town I lived in tried to tax yard sales.
That went over like a fart in a diving helmet.
 
I guess in depends on the state. In most states if you are selling merchandise as a business you must collect sales tax on the merchandise sold. An FFL dealer may not conduct sales outside the state that his FFL is registered in. He may have multiple FFL's for different locations in different states though.
 
I don't mind a legit dealer charging sales tax. I am no happy about it, but that's the rules and the guy has to go by it. What cheeses me off is the guy who is not a dealer charging tax and you KNOW the State doesn't see that.

If I think that's the case, I ask for a receipt. If the guy complains about it or scribbles free hand on a scrap of paper you know he's ripping off the tax. Not much I can do about it, and I've kept quiet, but you touched a nerve.

It's the same at flea markets, but there I ask, "Does that price include the tax?". The smart ones pick up on it and say "yeah". Sold! The others I pass on unless it's something I can't live without.

Oatka, that's exactly what I'm talking about! An accessories dealer from TX banged me for tax at a show here in AZ. The only receipt I got was for my credit card imprint. And YES, he did bang me for the 3.5% for that. I don't like that either, but at least I understand it, to a point.
I think I'll ask for his AZ re-sale license, a "detailed" receipt, and inform him I will confirm it via the Dept. of Revenue. That ought to stir 'em up, don't ya think!
