Revolver laws in NC.

I'm 18 & 1/2. To buy a handgun in NC, you must obtain a pistol purchase permit to buy the handgun or get a CCP. To get a CCP, you must be 21.

I want to buy a revolver. I'm thinking about a Ruger GP100 but there's a nice looking Taurus revolver at my local gun store. My question is this.

Coould I get my dad to by the pistol permit but I buy the gun. Or could he gift the gun to me? I don't want to get him in trouble.

I also feel I should mention that I don't intend to carry this gun concealed illegally. I aim to use it for plinking & having under my desk at work.

I'm not sure of the laws in NC but if you were under age and were caught with a gun at work under your desk you'd be in big trouble, especially if your job doesn't allow guns on their property. Also if your dad buys a gun and gives it to someone that is underage to have one that is illegal as well. I know it sucks but you have to wait until you’re of legal age to buy one there isn’t anyway around it. This is solely based on my opinion as I’m not an expert and don’t claim to be. I also don’t know your laws there might be a loop hole.

I work at my own store so that's not an issue.

I heard that I can buy a handgun, just not from a FFL. Does anyone know about that?:confused:

That's correct under federal law. You would need to find out if NC law is more restrictive, however.
 
Call your local sheriff. He rides herd on gun permits and should be able to speak authoritatively. Me? I'd sweet talk Pa into buying a revolver for his use with the agreement that you could use it from time to time. Spend the time between now and when you turn 21 to get real good at shooting. Classes, practice, the works.

Does it matter if I give him the money for it as a gift? He doesn't like to spend money on guns or anything fun. He's the type who when we make him go on a vacation with us to the beach, he'll sit in the hotel watching CNN and eating ice cream while we swim.

I'm a fairly good shot with my 10/22 but my AK is awkward to shoot. I'm sure I could hit a man sized target but mostly I just shoot 2 liter soda bottles.

EDIT: I just called the sheriff. He said you had to be 21 just to get the gun permit. I guess I'll talk to my dad. This is insane. I can buy a AK with a 75 round drum but I can't buy a little 6 shot revolver! *get's headache*.

You can't do that under NC laws. Its quite clear in the laws they created.

Under North Carolina law, it is unlawful for any person, firm, or corporation to sell, give away, transfer, purchase, or receive, at any place in the State any pistol unless the purchaser or receiver has first obtained a license or permit to receive such a pistol by the Sheriff of the county where the purchaser or receiver resides or the purchaser or receiver possesses a valid North Carolina issued concealed carry permit. This requirement to obtain a permit prior to the transfer of a pistol applies not only to a commercial transaction, typically at a sporting goods store, but also between private individuals or companies throughout North Carolina.

In addition, this State law has been interpreted to require that a pistol permit be obtained by the receiver of a handgun when such person inherits a pistol as a result of the death of another person. The permit should be given to and retained by the seller or donor of the handgun. In such a case, the permit should be given to the executor or receiver of the estate of the deceased person. If the purchaser or receiver uses a North Carolina issued concealed carry permit for the transfer, the seller should reference such permit on a bill of sale.

So under NC law for your father to give you that gun legally you have to have a handgun permit and therefore you still need to be 21. However its still legal for your father to own the gun and for you to borrow it. Just can't keep it. You just going have to wait till your 21 like everyone else in NC.
 
Be careful, as your father buying a weapon for you to use solely would be a Strawman Purchase, and a felony for him. For him to get a pistol permit, and for you to buy a pistol using it is also going to be a violation of the Strawman provision of Federal Law.:eek:
