Re-enactor jailed

Holy crap! How does a 6 time felon gets his rights restored???? I know, they were all non-violent crimes and at least one was victimless. Nobody is harmed in a felony flight from law enforcement, right?

So his friends spoke on behalf of him, talking about what a nice guy he was, hard working, non-drinking, and enjoyed working for charities, yet the first time he blasts several spectators with live ammunition he lies to the crowd, engages in conspiracy with his girlfriend to hide the evidence, lies to law enforcement.

An emotional and apologetic Doering told Viken that members of the re-enactors group routinely checked each other’s guns before a performance to make sure they contained blanks.

Doering’s only excuse was that he was fatigued from trucking and in a hurry.

That hardly explains how it was that the re-enactors failed to check his guns or checked them, gave the OK, and he reloaded with live ammo.

What I don't understand is that he could have gotten up to 20 years, but only got 1/3 of that. What gives? He is a long term career felon who has now branched into hurting people, conspiracy, and evidence tampering and the judge and prosecution cuts him some slack?

I know, he didn't mean to harm anyone. Right. Got it. Given his criminal history, obvious disregard for the safety of others, and subsequent attempts at a cover-up, his intent is rather moot. He has demonstrated quite well that he is a danger to society and his felony history indicates he isn't law abiding.
 
The ATF can issue a good conduct certificate provided the felony wasn't committed with a gun. I knew this 30 years ago when an agent requested I dig up an old arrest record for someone who was convicted of the robbery of a gas station, while acting in concert with others. Another perp had a gun, but this individual wasn't armed at the time. He served about a year in prison and applied to be a correction officer in that same prison. This is strange, but very true and when you go back thru the years some of the best in LE had done time. But this I know still won't sit well with some. The agent advised me he was getting the job.

As far as the character in this thread is concerned, why they restore rights to some and not others I can't say. I do know that the individual is investigated in order to decide whether, or not they have any habitual negatives that may be cause for concern. At least that's the way it was back then. Then again, I remember when belonging to the Communist Party, or living with someone while not married disqualified you from becoming a police officer.
 
I met a fellow who was pardoned by president peanut king Cahtah and afterward was sworn into law enforcement. He crossed the River Styx many years ago.

Right, but what is interesting is that the guy apparently was in the business of getting his rights restored. It has been done in the past and apparently he was within weeks of getting rights restored in Minnesota. It wasn't like he was a one-time felon who go a pardon. He was a long term repeat felon. That is what is so bizarre.

Safely run events of this type are closely monitored and the guns checked prior to the event. Doerings fellow re-enactors failed to do their job.

Doering’s felony convictions made it illegal for him to own or possess a firearm or ammunition. He was charged with a federal violation of the law but was allowed to plead guilty to a lesser charge of tampering with evidence.

Doering’s criminal history reaches back more than 30 years in Minnesota. At one point, some of his civil liberties were restored, but it could not be verified exactly what rights were restored, Fulton said.

Doering’s last felony conviction was in July of 2001. He was within six weeks of having his civil liberties restored by Minnesota when the shooting occurred, Fulton said.

According to the Minnesota Department of Corrections, Doering served time in prison for two first-degree assault convictions in the early 1980s and second-degree burglary in 1990. He was also charged with escape.

Doering was back in custody in 2000 and 2001 after he was convicted of fleeing from law enforcement
 
The individual I dealt with had been arrested as a teenager and had no record of any prior arrests and a number of years past without any further incidents. Yet still it's hard to believe he was seeking a job where he had been incarcerated, but that really happened in the early 80's.

Under normal conditions where someone had a felony conviction for let's say a theft of more than $250, which is a felony in NY, it would be a shame to have their entire life ruined. People just don't realize how many felony statutes are in existance. Even unintentionally stepping foot in the wrong location could be a felony.

Obviously the guy in question is perverting the purpose of having a conviction set aside. Those individuals that allow this to happen should be held accountable as well.

Then they should not be committing the felony. Heck, they should not be breaking the law. They never seem upset about the consequences until they are caught.
 
Mr. Doering would not want to appear before me for sentencing. A lifetime of criminal conduct including a complete disregard for his prohibition from possessing firearms, coupled with, at the very least, negligent discharge of a firearm, would result in a maximum sentence, minus 20% for acceptance of responsibility (pleading guilty), followed by a maximum term of parole.

I think a citizen with a felony conviction can petition the court after time served to have their record expunged. I'm sure there is criteria on this subject that the court closely looks at. Mr. Doering. Again He'll get yet another chance to clean up his act at the tax payers expense. SSMcG

I disagree with this. He admitted they check each others guns and ammo. He lied and did not follow what would seem to be club rules.

Short of a strip search, there has to be some level of personal responsibility.
