I am wanting to purchase a handgun for my brother in law for Christmas. He has showed an interest in gettin training and at some point CCW. He has been eying a glock 17. Sooo, I look at the latest CDNN mag, and notice G17's, for a very good price. Here is the part that I am not sure about.

Can I call CDNN, order, pay for the G17 with my CC, but have him fill out the 4473 when it arrives? We both live in the same state, and he has no problems as far as the 4473 is concerned.

Or, can I just do all the above and gift it to him as intended?

You cannot pay, and have him fill out the 4473. That is the definition of a straw purchase.

Buy it with everything in your name from the FFL, and do whatever your state requires to privately transfer it to him.
 
Just how is that a straw purchase. I took my wife into my local gun store and let her pick out the gun she wanted. I paid for it with my CC and she filled out the 4473. No problems what so ever.

The problem is that the purchaser must be the one filling out the 4473.

You are the one paying for the firearm, so you are the buyer in their eyes. The idea behind this is that you could be bringing in someone with a clean record to fill out the 4473, because you can not.

The best thing to do is to either get her a gift card, or buy the gun with your name on the 4473 and give it to her however your state says the private party trasfer goes.
 
depending on your state law you can buy the gun in your name. You fill out the 4473 and on his birthday hand him a beautifully wrapped very heavy package.
This assume your state allows transfers between individuals.
A GIFT is not a "straw" purchase.

Because she was not the actual purchaser of the firearm and she purjured herself when she answered "yes" to question 1 on the 4473. (If she answered "no", the dealer wouldn't have been able to complete the sale.)

Now, would any law enforcement agency care in your case? Probably not, since it wasn't an intentional criminal act.
 
By definition, you order from CDNN, CDNN ships to FFL. You must fill out 4473 and pass NICS. There is NO straw purchase possible. You gift the G17 to BIL. No problem.

Maybe they live in a community property state and all of their accounts are treated as being co-owned.
