Private purchases?

Hello all...I reside in Michigan and am looking to buy a 9mm handgun; it will be used mainly for punching holes and plinkin; not sure on the exact model/brand I want but anyways. I have read up on all the things required for someone under the age of 21 to purchase a handgun and now all I am wondering is where can I find private sellers?! I was told that a gun show is a place I can find private sellers..where else can I find private sellers near my location though!? Thank you!

A person must be 21 years of age to purchase a handgun or handgun ammunition, and 18 years of age to buy a rifle or shotgun or ammunition, from a retail firearm dealer. (Title 18 of the U.S. Code -- Gun Control Act, 1968)

From your post I assume you are not 21 years of age. Therefore, you can not purchase a handgun without violating a federal law.

This is distinguished from owning a handgun by someone over 18 but under 21. Someone may give you a handgun as a present if you are over 18.

Correct me if I'm wrong..You must obtain a purchase permit from your PD and pass the basic safety questionare and then you have 10 days to purchase and then you must return the pistol to the PD to complete the transfer. A person under 21 canNOT however purchase from a Dealer I though...And I am 19 and enjoy collecting/firing guns as a hobby.
 
Craigslist, perhaps. Or something similar like Upillar. Howerver, I would say a gun show is your best bet, all sorts of private sellers usually hang out outside the building or walk around carrying items if they are only looking to sell an item or 2, not enough to warrant renting a table. Often enough, the wire-tie through the gun is a good bet that it is for sale in this case. But, often enough, private sellers looking to liquidate a collection will sell inside.

As you stated you are hypothetically under 21. My understanding is that it is illegal for you to procure a handgun for yourself. As Mello stated, parents are a different story though, I believe they can get it for you and transfer. If I am wrong, someone please correct me. but will also need them to get ammo for you as well.

This is entirely a matter of state law. I am not sure about MI.

CL policy bans firearm ads, and ads containing firearms on my local CL website are typically flagged with blinding speed. Users in other parts of the country report similar experiences. (Let's not hijack the thread to talk about whether CL's policy is fair or not- I'm just reporting the facts.)

If you are giving them the money, the answer is a very firm NO, they cannot legally do this. This act is considered an illegal straw purchase and is a felony violation of federal law. :eek: The transaction is only legal if the gun is a gift and no compensation is involved. (Search the L&CR subforum for more info about this topic- I realize it can be confusing for those unfamiliar with it.)

Act 372 of 1927

28.422 License to purchase, carry, possess, or transport pistol; issuance; qualifications; applications; sale of pistol; exemptions; nonresidents; basic pistol safety brochure; forging application; implementation during business hours.

Sec. 2...

(b) The person is 18 years of age or older or, if the seller is licensed under 18 USC 923, is 21 years of age or older.

The above clause appears to allow for private sales to those under 21, but follows U.S. law for purchases from dealers.
 
haha now that we got that squared away...Anyone know where I can find private sellers besides a gun sale? Its seeming to look like its only work of mouth from a family or friend selling one...
 
try the classifieds here and in a few other gun forums... and just specifically list you are looking for a ftf (face to face) sale.... if you find someone who is interested in selling to you from Michigan then before meeting you might want to let them know your age and a number of other things about you.... they are the seller and so all the rules, or most of them, are theirs.
 
Maxem I think you misinterpreted what I said...I was just saying that the only way to find a private sale is to hear of one for sale through word of mouth...wasn't sure if you understood that because I am in no way trying to acquire a straw purchase
 
Under FEDERAL Law a person under 21 but 18 or over can purchase a hand gun in a private sale. That person cannot purchase a hand gun from a licensed dealer (FFL).

I don't know what Michigan law is on private sales.
