Pepper Spray In New York City?

I currently live in Washington state and am going to New York for a short trip with my girlfriend. I want to bring my pepper spray with ( you know the good stuff the 5.3 million SHU ). Can I legally carry it in NYC.

First of all: If you are flying there, you can be charged with a federal felony for carrying it on an aircraft -- even if it is in the luggage compartment. Has something to do with the thing cooking off due to pressure differential and disabling everyone on the aircraft -- including the pilot -- and packing the damned thing into the ground.

Second: The only arms you are allowed to bear in NYC are the ones attached to your shoulders. Attica is not nice at any time of year.

I wouldn't take ANYTHING to NYC. Just be a good citizen and die like the rest of the victims. The cops will "tsk, tsk" over your untimely demise and go about their business as if you never existed at all; and the leadership will cry out to avenge your death -- by enacting more gun control.

I don't think this is correct. Better check as I think OC is ok in NYC. Also you can fly with it in checked baggage.
New rules.

Don't trust us - call the DA in NYC.

You can buy the spray in N.Y....and you will be better assured that it is legal. If you have contacts there ask them to get you some and meet at the Airport?

When i was there few years back they just made it legal, ran out and got some... where there is a demand there will be a supply!

You're limited to a 0.7% OC solution in NY. Good luck even FINDING anything that diluted (no limit on SHU level though). If you can meet that, email me at carl@donath.org for additional factors (don't have the law book with me right now).

Better idea... Take a couple of pairs of black socks. Put one inside the other. Use them to carry your pocket change.

Don't do this in the airport.

Actually, Mace brand does make a 5% solution. There is also a restriction on canister size, and certain written warnings must be on the cannister for it to be legal or the cannister can be seized.

Bogie,

What you describe is, under the wording of the law, considered a sap. Go straight to jail in NYC.

Why don't you contact Greg Hamilton at Insights Training? They are just outside of Seattle and offer both Unarmed Self Defense & Defensive Folding Knife classes. The program's are outstanding and are an excellent supplement to gun training as then will have non-lethal & lethal methods of protecting yourself. In addition to being practical, the class is fun as well.

I am not at work so I do not have my books at hand, but taking that on an airplane may be a violation of the laws governing the air transport of hazardous materials. It has nothing to do with weapons laws. The airline will have a policy on it, you could call them--just don't tell them who you are.

On a practival, not theoretical level...

...if one checks an unloaded cased firearm in Denver and flies to NYC, would the person be arrested at the airport or would the baggage and the passenger be re-united uneventfully? I am curious as to the practicality of taking weapons in when flying, not the legality?

PS: If you have not read Brian Garfield's "Death Wish", it is a must-read. So much better than the film and better writing than most pro-RKBA books, IMO.

and certain written warnings must be on the cannister for it to be legal or the cannister can be seized.

Yes, I have heard that in some States they must be inscribed: "For Self Defense Purposes Only." This leaves my 90 gram cans out since they either say nothing along those lines or they say, "For Felonious Purposes Only." I tried to return them to the gunstore but the owner pointed to the sign above his counter, "All Sales Final." Damn.

My Toyota has a sticker in the engine compartment which warns: "Do not operate heavy machinery when intoxicated." If I remove that sticker...automatic felony, at which point my pepper spray would come in handy.

If you can bring pepper spray to NYC, you can carry it safely, bacause as opose to firearms, OC cans have no serial number and can not be traced. If you do have to use one, just drop it right away and it can no be connected to you, unless your fingerprints happen to be in NCRD, AND you caused serious enough damage to the attacker thhat prompted him to seek medical treatment and NYC police have really nothinh better to do then investigate OC can use through federal channels (not even remote chance they will do that unless you killed somebody with your spray).

That's sad that it would be illegal. They have pretty much reduced the armed populace to nil and if one wants to protect themselves with a little spicy spray, then it's just too bad (seems that the the closest you'll get to pepper spray in NY and other goober cities is to tote around a bag of cayenne)
