Patted down

So my wife and I (I'm 66, BTW) are driving a rented car from our home in Texas to Branson MO on vacation last Friday (still there, having a ball) ... I'm in the right lane, cruise control on the speed limit, when I get lit up by an Arkansas patrolman ...he comes to the passenger window and I immediately inform him that I have a Texas CHL and there is a loaded firearm in the car. He asks where, I tell him in the driver door pocket ... he tells me to leave it there and get out of the car, leads me to the back and tells me to put my hands on the truck so he can pat me down (?!) ... then I have to sit in his car while he tells me he pulled me over because my right front wheel touched the curbside white line ... well, ok, my bad, so what? he's very pleasant, not abusive, gave me a warning and sent me on my way ... the wife and I figured he was bored, saw an out-of-state plate and thought he'd kill 15 minutes ... first time in the eight years I've had my plastic that I had to show it, interesting experience ...

Right front wheel touching the curbside white line???????

If this had been a reason for being pulled over in Italy we would need some millions partol cars.

Cutting the curbside line when turning is the basis of sport driving!

Nice to hear things turned out right.

I would bet the real reason you were pulled over IS your plate. A lot of drugs come out of Texas and other border states.

I do find it very nice that he said nothing about your firearm. Here in Missouri I have been stopped a few times (I really need to get the speedometer fixed!) and when I tell them I have a gun in the truck, I am asked to stand outside of it.

Only once have they ever removed the gun. They usually just close the door after I get out.

I handle verbal warnings at the offender's window. Generally if I bring you back to the car, I'm seeing if you smell like hooch, the evil weed or going to question you about criminal activity. In those cases, I may pat you down.

I am aware of one instance in which an officer got his throat slashed while questioning a DWI suspect he hadn't patted down before placing him in his patrol car. The officer survived and the slasher got broke from sucking eggs right there.

Sarge, thanks for the input ... interesting aside, given your info on the slashing, the officer asked me if I had any other weapons on me before he patted me down and I pointed to a 3-inch folder clipped to my left front pocket ... he said, "don't worry about that" and left it where it was ...

My guess would be that the officer wasn't worried about the knife since you immediately told him that you had it, and where it was. I could be wrong, of course. But my normal assumption is that they aren't worried about what you have, they worry about how you act. There are exceptions (see Canton, OH), but I'm pretty sure those are a very small minority.

lol, should i stay out of canton? i drive thru there on a regular basis with my piece, but have never been stopped. don't think i would ever drive thru canton without my piece for that matter, especially after dark. shady.

Do a search. Be ready to re-think Canton, at least until Council Chair Schulman and the PD come to their senses.

woa! how did i miss that? i have been pulled over in nearby Hudson, and when i told him i had my ccw, he didn't even ask for my license. he just told me to have a nice day. i was doing 70 in a 45 btw.

i was literally just in north canton for their balloon festival a couple of weeks ago. my friend and i were both packing for that. there were cops everywhere. good thing i wasn't printing!

Webster, TX ....

Falls into the same category as Canton. Know of 2 people, one of them my uncle, who have been arrested for unlawfully carrying when they were both in complete compliance with carry laws. Both have had charges dropped and exponged but not until after they paid 8 grand for bail and an attorney.

Maybe, and Kent (if you travel near Hudson) for that matter if you can help it, bunch of jackbooted thugs there, but that is a matter for another thread. KPD and I have an..."interesting" history...

Back to OP topic: Not to reference you as old or decrepit, but he seriously had a 66 year old man exit his vehicle, submit to a pat-down, and put you in the perp seat for a bit? I have to wonder why? You didn't mention it so I assume he did not search your car, which I assume would have been done if he had suspected narcotics trafficking, as Uncle Buck suggested.

Did he question your wife at all? Or merely leave her unattended while all his attention was on you?

Seems very strange, but glad everything worked out well for you.

stressfire, he did not search the car, did not question my wife ... and while I am 66, I'm not old or decrepit ... :D we wondered why too, thought about asking but figured he might change his mind about the warning ...

Lol, usually a good idea. Nothing like saying "Excuse me officer, but aren't you going to search the car?" To get you not only a very strange look, but also make the stop last about 30 more minutes, longer if he has to wait for backup to arrive.

not old or decrepit ...
Darn, I was hoping you might miss that part :D

But in any case, very strange

"wheel touched the curbside white line"

You should have asked him if he had a fishing license for his fishing expedition.

:D

No wonder people lose respect for the police. My father was a state trooper and strongly disliked low rent mickey mouse cops.

maybe this is because i'm young but here in florida when i get pulled over and tell them i have a loaded weapon i usually get pulled out of the car and patted down. once i even was put in handcuffs till they ran the serial numbers on the gun. one upside to this is after all this they usually let me go with a warning. btw i do have a cwp.

As far as I know, the requirement to inform LE that you are lawfully carrying varies from state to state. In my state (Oklahoma) we are required to inform LE at the beginning of any contact, but we may NOT be subjected to searches and our firearms are NOT subject to inspection. As far as I know, Arkansas (I live close to the Arkansas border) has no requirement that CCW holders inform LE of their weapons. As a matter of fact, Oklahoma law expressly forbids LE from asking to inspect the firearms of CCW holders, unless they are hunting.
