Texas teens who vandalized veterans park get customized punishment

The Associated Press

PORT ARTHUR, Texas (August 29, 2000 9:45 p.m. EDT http://www.nandotimes.com) - Nine teenagers must watch the movie "Saving Private Ryan" and read "The Greatest Generation" after pleading guilty to vandalizing a veterans park and causing more than $45,000 in damage.

District Judge Charles Carver also ordered the nine to write 1,000-word essays due Dec. 7, the anniversary of the Japanese attack on Pearl Harbor.

Carver said he hoped the teens would learn about "the sacrifices of American soldiers in defense of your freedom."

They could have received a maximum sentence of 180 days in jail.

The punishment was handed down Monday as part of a plea bargain worked out in cooperation with veterans.

"We didn't want to destroy these kids lives by sending them to the penitentiary. We wanted to show them we are a compassionate generation, too," said Herb Stafford, a Veterans of Foreign Wars post commander.

The damage was done to the Golden Triangle Veterans Memorial Park during February, including the removal of plaques carrying the names of veterans who served during World War I, World War II, Korea, Vietnam and Desert Storm.

Eleven of 14 concrete benches in the park were toppled, and a pane of glass in the top of a fighter jet cockpit was shattered. A window was broken in a helicopter, and its door was torn off and stolen.

"The Greatest Generation," is Tom Brokaw's book about the generation of Americans that dealt with World War II. "Saving Private Ryan," the blockbuster movie about the war, opens with the brutally realistic storming of Omaha Beach on D-Day.

The judge ordered the nine, who range in age from 17 to 19, to also serve two years probation, apologize to veterans who helped build the memorial 10 years ago, pay a $500 fine and perform 400 hours of community service.

So, they get to watch a great movie, read an ok book, and write an essay (real literary geniuses I am sure). Bull$hit. They should be made to do scut work in a VA hospital for a couple of months and see the real sacrifices these vets made for the country.

I don't see anything wrong with the punishment that they received.

Allen_Raiford also had a good idea for proper punishment.

However it seems the judge conferred with local vets before deciding what the punishment would be and if the local vets are satisfied then so am I.

I'd go along with this sentence, but nowhere do I see mention of restitution for the $45K in damages.

In Vermont, this would be similar to our Reparative Board programs, where non-violent offenders are given sentences like this one in order to restore their victims and the community. A big part of that is restitution for actual losses.

Panzerfuehrer, Vermont? I am on one of the reparative boards (Addison County), and you are absolutely correct. The "punishment" is carefully considered and relates directly to the crime, with the outcome being an increased awareness and appreciation of what one actually did. Most of our perpetrators end up in tears when what they did is brought up close and personal -- a painful revelation.
I wonder if these kids were made to meet with the veterans involved; that is very effective.

Chittenden County here.

Yep, it looked like a personal apology to the vets was part of the deal. $45K divided by 9 sounds like $5K apiece. They must have had a real party.

Too bad in VT the defendants "ability to pay" is given such weight, but I think it's still a pretty good system.

$45,000 divided nine ways is $5,000 each. This should be served as "community service" at minimum wage until it's paid back. (This is IN ADDITION TO the "creative" sentence handed down by the judge.)

But I guess I'm just echoing the sentiments of previous writers...

One more punishment they should have in addition too the above mentioned.Send them to 3mo Army or Marine Corp boot camp.

Hell, we might end up with some patriot`s. It will make them or brake them. Those that brake, send them to jail, to see what awaits them.

SORRY, but I don`t have much tolerance for someone that defiles the Honored Dead.

Court ordered military service (Marines or Army) with attachments to their files explaining what they did. They must also confess their crime to their basic training company. The rest will be in God's hands.
