Ohio Provisional Ballot Ruling Reversed

CINCINNATI (AP) - A federal appeals court ruled Saturday that provisional ballots Ohio voters cast outside their own precincts should not be counted, throwing out a lower-court decision that said such ballots are valid as long as they are cast in the correct county.

The ruling by the 6th U.S. Circuit Court of Appeals supports an order issued by Ohio Secretary of State Kenneth Blackwell. Democrats contend the Republican official's rules are too restrictive and allege they are intended to suppress the vote.

The state's Democrats had filed a lawsuit challenging Blackwell's directive instructing county elections boards not to give ballots to voters who come to the wrong precinct and to send them to the correct polling place on Election Day.

Blackwell has said allowing voters to cast a ballot wherever they show up, even if they're not registered to vote there, is a recipe for Election Day chaos.

The Ohio Democratic Party and a coalition of labor and voter rights groups argue that Blackwell's order discriminated against the poor and minorities, who tend to move more frequently.

U.S. District Judge James Carr on Oct. 14 blocked Blackwell's directive, ruling that Ohio voters who show up at the wrong polling place still can cast ballots as long as they are in the county where they are registered. Blackwell appealed to the 6th Circuit.
Members of the Ohio Democrat party should be ashamed of themselves for arguing that the poor and minorities of Ohio aren't smart enough to figure out where to go to vote.

This provisional ballot issue is going to be a fiasco. :(
 
K80Geoff, I believe you're spot on. In addition to the case Bluesman just pointed to, we have the New Voter Project registering kids on campuses without asking for ID, forging signatures on registration forms, offering bribes, and a whole slew of other felonies. The universities are looking the other way.

Here in Milwaukee, the Democrats went after the county executive (a Republican) because he refused to approve the issuance of 960,000+ ballots to the city. That's almost three times the number of registered voters, and much higher than the number of people who are even eligible to vote.

The New Voter Project has now gone into the county corrections center and registered felons.

In 2000, Democrats who engaged in illegal voting activity just got a slap on the wrist. This time, they'd better go to prison.

If I heard correctly, voter fraud is no more than a class 5 felony, little more than a misdemeanor. Treason may be more appropriate.
 
I'm going to vote as early as possible next Tuesday. Then I'm going to take down my Bush/Cheney signs.

After that, I'm going to load up every AR magazine, load the shotgun tubes, fill every revolver cylinder and speedloader, and top off every pistol magazine.

I'm going to keep the windows closed, but the screens in the "up" position. It's a lot easier to bust a window quickly than tangle with a screen.

With the level of absolute hate on both sides, I really believe the potential for major violence is there.

If I'm wrong, all it will have cost me is a few more dollars for the gas heating bill. Small price to pay for peace of mind.
 
That sounds a little extreme, Dick, but then again, I don't know what kind of neighborhood you live in. If, indeed, there are riots you will certainly be prepared. In my neighborhood, I don't have to worry about that (thankfully), though I am also prepared. :)

It is interesting to note that if Bush loses, Dems are not worried about Reps rioting, but the converse is not true.
 
Looks like it's going to come down to counting Ohio's provisional ballots to satisfy Kerry that he lost.

So be it. Start counting. Then we can stick a fork in him.
