MEASURE 5 UPDATE.
OFF NEEDS YOUR HELP.
The first large gun show since the passage of Measure 5 was this past
weekend in Portland.
Many regular attendees refused to buy or sell because of uncertainty
about the law and concerns about the databasing. More on this later, but
first, a request for help.
As you know, Oregon Firearms Federation is involved in a number of legal
actions in the state. One of particular concern to us involves the
treatment of pistol license applicants by various Sheriffs
We are aware of several Sheriffs who have been giving out false
information to applicants, producing applications that are not in
compliance with the law and other irregularities.
A lawsuit was filed against the Sheriff of Multnomah County because of
his alteration of the pistol license application.
Although there was a partial victory for gun owners and the Sheriff was
ordered to correct the application, he's still giving out applications
that ask for personal information to which he's not entitled.
Furthermore, his office is also refusing to accept applications from non
citizens in direct violation of the law.
The Sheriff, Dan Noelle, was, of course, one of the sponsors of Measure
5.
An appeal will be filed to seek a complete victory over Noelle, but your
help will be needed because we are trying to get pistol license
applications from every county in Oregon.
If you live in any county other than Clackamas or Multnomah and you can
acquire a copy of your county's concealed handgun license application,
we'd appreciate if you could mail or fax them to OFF. (Contact
information is above.)
Now, on to the show.
Most attendees seemed to agree that activity was way down. A lot of
people were amazed by some of the provisions in the law of which they
had been unaware . For example, many were shocked to find out they were
required to use a credit card to pay for the gun registration background
check.
People without credit cards and cell phones were effectively locked out
of any transactions. And they were the lucky ones.
We witnessed one transaction between two private parties that required 3
separate calls and 20 minutes of cell time to complete. The folks at the
state police seemed utterly baffled trying to complete the transaction.
But far worse was the proof of what we had been warning about since this
terrible law was being debated as HB 2535 in the 1999 legislature.
We (along with a reporter from KPAM radio) listened in on a scanner that
was intercepting many of these transactions. Anyone with access to one
of these easily acquired devices now has the freedom to get the names,
addresses and phone numbers of gun buyers and sellers, along with the
serial numbers of their guns, and...their credit card numbers and
expiration dates! (Street value, about $600.00 each.)
KPAM radio reported that the State Police are "concerned." Something
they were NOT when we warned them of this in 1999. Please keep this in
mind before you conduct any transfers using a cell phone. And don't
think digital phones are safe. Experts have informed us they can be
intercepted as well.
We are still examining legal challenges to Measure 5 and will keep you
informed. Any help you can give us with those license applications will
be greatly appreciated.
