NYS Carry Permit

I have the NYS CWE carry permit which states that it is granted for "target shooting, hunting, hiking, camping and fishing". I am trying to find a clear cut answer as to when and where I can carry. I have read the NYS laws on the subject. What is stated is there is no law that gives any municipality the right to restrict a permit, though many do. I was told that the Troopers don't recognize any restrictions. I doubt that. Any experience from you all in NYS with your carry situations? I want to know if It's OK to protect my family without having to take them fishing. Thanks.

You wouldn't happen to live in Erie county would you? I just got my permit and it is "restricted" to hunting/target by my county (Erie). If I lived three miles due north in Niagara County I'd have an "unrestricted" permit. I've heard the same as you that Troopers don't acknowledge restrictions. I plan on carrying if my wife and I will be going into an area that we feel is unsafe regardless. I'd like an answer to that question as well. Also, I'm interested in knowing if I'm restricted by my county, can I still carry in other counties?

Upstate NY has only three counties that offer any restrictions on the permit when issued. They are the counties surrounding Albany (Orange county I think), Rochester (Monroe county?), and Buffalo (Erie county). All other counties offer an unrestricted permit, meaning that you can carry anywhere in the state that it is legal to do so (no federal buildings etc.). The permit is a state permit, valid in all counties except New York City; it is just easier to obtain in some counties.
I have also heard that Troopers won't bug you about carrying concealed with your target/hunting permits. After all, the process for obtaining it is the same and it is a statewide permit. And you can always say you were on the way to the range.
Can you imagine getting a different class of driver's lisence just because you live in one county or another?

ds1973: I lived in Erie county for several years, but I didn't apply for my permit until I moved to Niagara county last year. I took my permit course in Erie county so I got to see the differences first-hand.
 
I too have a concealed carry license which is limited to "target and hunting" I live in Saratoga County. I have never been able to get a definitive answer. At the shooting safety course required for obtaining a permit I was told that "as long as you don't go flaunting it and do in fact keep it concealed, the troopers will not hassle you."
There is no provision in the law for concealed carry with restrictions. However, the issuing officer, in my case a local judge, has the discretion to place resticictions on your license. This is more a matter of county to county policy. It may not be legal under the state constitution but what are you going to do? I've read several court cases on this matter and they all conclude, rightfully or not, that the issuing officer has restriction placement authority. I never carry, other than for target and hunting, however, if I felt my safety or that of my family was at issue, I would. I have heard the same about the policy of the state police as you have. I know many people who do carry regularly with our type of license. What I'd really like to know is WHAT IS THE OFFICIAL POLICY OF THE NYS POLICE. Do we have any NYS troopers on this board? Yes This is what I'm hoping for an "unofficial " post from an officer that can shed some light on how you guys view this "sportman" permit. I live in Rockland County, 30 miles north of NYC. Thanks - cello

You gotta be in the City of Tonawanda or Amherst, right? I lived in Tonawanda (Parker and Eggert) for 14 years, then in Buffalo (Main & Winspear) until last April when I moved to Savannah.

The NYS laws are partially what prompted me to get the hell out of NY!

Good Guess joegerardi. Yeah I'm in the town of Tonawanda. Just off of Colvin Blvd. When I'm done with my degree here, I'll probably leave the state. If I find a good job in NY (Laughter) then I'll just have to continue fighting the commie left. That's the problem when we leave, the pro-gun numbers fall and the anti-gunners get stronger. NY may be a lost cause.

Don't get me started on NYS permits! I live in Suffolk county. The permit I have says Target and Hunting only. The county PD restricts us to target and hunting even though the county Legislature passed a law requiring the PD to follow the state guidelines. The Police commish refuses to comply and restricts our licenses IN TOTAL DISREGARD OF COUNTY LAW.

This is what NE Republicans and Liberals get you. And you PRC residents think you have it bad!

I'm told by a LEO that upstate pistol licensees can carry concealed in Suffolk County! But Suffolk county licensees cannot carry concealed upstate! What a goat****!

Don't get me started on NYS permits!

This is turning out to more confusing than I thought.Looks like we ae all in the same boat. Has anyone had an instance where they were "made" and told to "go home" or arrested because they were operating outside of the limitations placed upon their license?
 
Thanks for the input. My next step is talk to some LEOs. I'm not sure how candid they are allowed to be, even if they are pro-gun.
 
Broome County also restricts carry permits. The judges there have an unwritten rule of only accepting sporting purpose permits. (Ask them if they'd rather a loved one be armed, or raped).
