who today caved into the Bradys by settling the DC maniac rifle case on their part for $550,000.00 and "no admission of liability."

Bushmaster--you guys are dumbasses to think that now that you've paid them, they won't now try for your wallet again. I am glad that this settlement went down before the death of the AWB, because I suddenly find myself not considering the rifles now so ironically stamped with a snake.
 
Sounds like a mammoth cop-out but .... would be interested to know some ''behind-the-scenes'' info on it all. Guess I am looking for some glint of good reason .. if such could even exist!
 
SELLOUTS seems a valid term, thought who knows but what the company thought this was their least expensive wady out.

Sad to note, this sort of thing only encourages these idiot lawsuits.

That's why the term, "sell out" is appropriate. They made their choice based on money only.
 
Don't expect a private company to fight a societal battle if those with a stake in that society aren't going to help.

In other words, how many "Bushmaster Defense Funds" did anyone here donate to? What did the NRA do for Bushmaster?


And heh, maybe their dealer with 200 unaccounted firearms :eek: would have given Bushmaster a legal black eye in court. I'm not saying I think Bushmaster DID do anything wrong, but if there was a doubt, this is a much better out for them.

None. It's more fun to get spittle on one's monitor while answering all the questions right on one's "Gun Owner Purity Test" than to actually get involved. ;)
 
I get a giggle out of people who think that a private business is going to risk bankrupcy to teach the liberals a lesson. Of course if they win, the entire American legal system will take notice and no further civil actions will ever take place. :rolleyes:
 
Being angry at Bushmaster for choosing not to fight and "Selling Out" is like being angry at the corner grocer who refuses to kick the Mafia thug collecting "protection money" in the balls.

They stood to lose much more and basically paid this "legal extortion" to the corrupt trial lawyers who are using a corrupt system to do basically what the mafia thug in my analogy is doing.

I guess y'all would have been happier if Bushmaster would have been put out of business by a multi-hundred-million dollar, precedent setting judgement by some jury full of soccer moms and bliss-ninnies. :rolleyes:

I am pretty sure that through fighting the case Valor, the distributor held liable in the sensational $24 million dollar "Brady victory," paid nothing near that amount. In fact IIRC, they had won the case on appeal and began threatening the plaintiff for costs.

Windham, Maine -- The Washington DC Brady Group would have you believe they won some kind of victory! The Brady Group brought this lawsuit not for the victims, but for their anti-gun agenda. The Brady Group asked for the settlement conference after reviewing all the evidence they knew they could not be successful in court and they wanted to stop paying lawyer fees.

The Brady Group sent a second tier lawyer to the settlement conference with nine demands on Bushmaster regarding business practices and Bushmaster denied them all. We then gave the Brady Group our statement that we support the BATF licensing requirements to be a Federal Firearms Licensed (FFL) holder and our support for the National Shooting Sports Foundation (NSSF) safety programs, and they accepted our statement. We did not agree and would not agree to change the way we do business or make any additional demands of our customers. We were emphatic that Bushmaster did not commit any wrong doings.

The attorney for our insurance company was at the settlement conference and informed us that about half of our policy limits had been spent on trial lawyers. It was the insurance company’s position that all of the limit would be spent on this case, and therefore turned the funds over to Bushmaster to use as we saw fit removing the insurance company from the case. Our choice was to continue spending it on trial lawyers or turn it over directly to the victims’ families with no funds going to the Brady Group for their legal fees.

We felt the compassionate thing to do was give it to the victims’ families, not because we had to but because we wanted to. The Washington DC Brady Group should learn what compassion is really all about!

Bushmaster strongly believes and vigorously supports the rights of citizens to own and use firearms, and the settlement of this case in no way compromises that stand. The Brady Group’s attempt at claiming a victory over firearms manufacturers is a hollow one with no substance. Their attempt to eliminate gun rights of citizens has failed legislatively and will continue to fail with these frivolous lawsuits against gun manufacturers.

This was probably a good settlement based upon the costs of the litigation. Insurance pays for defense and indemnity when one is sued- the insurance company gets the right to settle or continue with the suit. This was most likely a business decision. Reread Tamara's post.
 
This is a very unusual situation. I am very familiar with insurance defense, and the sort of policy wherein liability limits are reduced dollar-for-dollar with defense costs is very unusual. It's also unusual to have the insurer give control of the funds over the the insured corporation. This was not a sell out. Bushmaster had to decide whether to give the money to lawyers or donate it to victims, and chose the later course in spite of the political heat. They made NO changes to their policy and did not sign on to anything like the infamous S&W settlement agreement. This was a pure cash for release settlement, with all funds going to the victims and no admission of liability. I see nothing wrong with that.

Those who don't want to click on that link don't want to read anything, Dave, nor do they want to think anything through. They just want to score big points online through proper posturing and clicking the right answers on their "Gun Owner's Purity Test."
